PROSES PERUMUSAN UNDANG-UNDANG REPUBLIK INDONESIA NOMOR 2 TAHUN 2011 TENTANG PERUBAHAN UNDANG-UNDANG NOMOR 2 TAHUN 2008 TENTANG PARTAI POLITIK

2013 | Tesis | S2 Magister Adm. PublikPenelitian tentang proses formulasi kebijakan public di Dewan Perwakilan Rakyat Republik Indonesia (DPR RI) jarang dilakukan. Padahal DPR RI adalah pusat proses formulasi kebijakan public dan hukum di Indonesia. Penelitian ini mengangkat tema proses perumusan Undang-Undang Republik Indonesia Nomor 2 Tahun 2011 Tentang Perubahan Atas Undang-Undang Nomor 2 tahun 2008 Tentang Partai Politik. Ada dua pertanyaan penelitian diajukan untuk menjalankan penelitian yakni; 1. Bagaimanakah proses penyusunan Undang-Undang Nomor 2 tahun 2011 Tentang Perubahan Undang-Undang Nomor 2 Tahun 2008? 2. Pokok-pokok kebijakan apa sajakah yang menjadi perdebatan dalam permusan undang-undang itu? Metode penelitian deskriptip digunakan untuk menjelaskan proses perumusan undang-undang tersebut. Dalam penelitian ini data dikumpulkan dengan berbagai metode seperti studi literatur, kualitatif riset, wawancara mendalam dan observasi. Dua alat kelengkapan DPR RI yakni Badan Legislasi (Baleg) dan Komisi 2 menjadi unit analisa . Dari proses pembahasan perumusan undang-undang pada dua alat kelengkapan DPR tersebut dapat dibedakan model, sifat dan konten bahasan proses perumusan RUU tersebut. Proses perumusan undang-undang di Badan Legislatif merupakan proses kelembagaan di mana DPR mengkonsptualisasikan inisiatip perubahan Undang-Undang nomor 2 tahun 2008 menjadi Rancangan Undang-Undang (RUU) Inisitip DPR sesuai dengan ketentuan Tata Tertib DPR RI. Sementara pembahasan di Komisi 2 adalah proses pembahasan RUU inisiatip DPR dengan pihak pemerintah setelah RUU inisiatip tersebut ditetapkan sebagai RUU inisiatip dalam sidang Paripurna DPR RI. Kemudian dua proses tersebut dibandingkan dengan formulasi kebijakan model RIA (Regulatory Impact Analysis). Dari perbandingan tersebut maka dapat diketahui bahwa perumusan Rancangan Undang-Undang Perubahan Undang-Undang Nomor 2 Tahun 2008 menjadi Undang-Undang nomor 2 tahun 2011 tentang Partai Politik lebih berbasiskan pada hajat politik (political will) dan otoritas politik sebagai lembaga perwakilan rakyat dari pada tuntutan publik dan prioritas publik. Oleh karena itu agar hajat politik tuntutan publik dan prioritas publik menjadi basis dalam perumusan undang-undang di DPR RI maka model RIA dan ketentuan-ketentuan prosedur perumusan undang-undang dalam tata tertib DPR perlu dikombinasikan dengan mengamandemen Peraturan Tata Tertib DPR RI.
The research theme was the formulation process of the Republic of Indonesia Act No. 2 of 2011 concerning Amendment to Law No. 2 of 2008 on Political Parties. There were two research questions posed to conduct the research which were; 1. How did the process of formulating the Act No. 2 of 2011 concerning changes to the Act No. 2 of 2008 ? 2. What did the main point’s policy debate in formulating law? Descriptive research method was used to describe the process of formulating legislation above. The research employed various methods such as literature study, qualitative research method using indebt interview technique and observation. Unit of analysis of this study was two agencies in the Parliament, that is; Legislation Agency (Baleg) and the Commission II. From the process of formulating on the House those agencies, it can be distinguished the models, the nature of the content and the emphasis of the discussion over the bill formulation process. The process of formulating legislation in the Legislation Agency was debating the institutional process of conceptualizing law to Bill (the Bill) initiative by the House. The Bill initiative debate was the process of formulating legislation changed the Act No. 2 of 2008 to Bill (the Bill) Initiative in accordance with the stages of the process of discussion which was determined by the Parliament Ruled of Conduct regulation. While the discussion in the Commission II was conceptual discussion process between the two parties that is the Government and the Commission II after Parliament formally decided on a draft bill initiative in the House. The Commission II as a representative of the House of Representative that have been proposed Act Initiative, while the Government as the party responds to initiative bill the House of Representative. Therefore, the main subject discussion is Government policy respond to The House Initiative Bill. Then the process of formulating the law on two Parliament Agencies above compared to the Regulatory Impact Analysis (RIA) formulation policy models. From this comparison it can be seen that the initiative bill the House of Representative on formulating a change of Law No.2 of 2008 into Law No. 2 of 2011 on Political Parties is more politically charged nature. This is because the process of discussion based on the political intent and interest of political authority rather than the demands of public and public priorities.
