Analisis yuridis konsistensi asas manfaat dalam hukum investasi di Indonesia

2010 | Tesis | S2 Magister HukumTesis ini mengkaji analisis yuridis tentang konsistensi asas manfaat dalam Hukum Investasi Indonesia, khususnya Undang-Undang Nomor 25 Tahun 2007 tentang Penanaman Modal(UUPM No. 25/2007) terhadap tujuan kemakmuran sesuai prinsip ekonomi dan cita-cita konstitusi. Juga diteliti bagaimana ketetapan dalam UUPM No. 25/2007 memberikan perlindungan terhadap risiko dominasi asing dan penyimpangan dari asas manfaat dengan mencari dan menafsirkan pokok-pokok ketentuan dalam UUPM No. 25/2007 yang mempunyai kekuatan dalam memberi perlindungan hukum terhadap risiko dan penyimpangan dari asas manfaat tersebut. Asas manfaat adalah asas, di mana di dalam penanaman investasi dapat memberikan manfaat yang sebesar-besarnya bagi kemakmuran rakyat, yang sejalan dengan Pasal 33(3) Undang-Undang Dasar 1945 yang berbunyi “Bumi dan air dan kekayaan alam yang terkandung di dalamnya dikuasai oleh negara dan dipergunakan untuk sebesar-besar kemakmuran rakyatâ€. Penelitian dilakukan dengan menggunakan pendekatan yuridis normatif. Ketetapan-ketetapan dalam UUPM No. 25/2007 dikaitkan dengan hal-hal yang berkenaan dengan nilai guna dan efisiensi yang mungkin dihasilkan serta tujuan kemakmuran sesuai asas manfaat dan cita-cita konstitusi UUD 1945. Penafsiran dan penalaran atas tinjauan terhadap konsistensi dan perlindungan hukum tersebut disampaikan secara logis analitis mengikuti langkah-langkah yuridis. Dihasilkan bahwa Hukum Investasi Indonesia, khususnya UUPM No. 25/2007 telah secara konsisten diarahkan pada tujuan kemakmuran sesuai asas manfaat dan cita-cita konstitusi UUD 1945 dan memberi perlindungan hukum terhadap dominasi asing dengan pembebanan kewajiban bagi penanam modal untuk melaksanakan tanggung jawab ekonomi dan sosial.
This thesis researches legal analysis upon consistence of benefit principle in Indonesian Investment Law, in this matter Law No. 25 of 2007 on Investment (UUPM No. 25/2007) with the economic principles and the goals of the constitution. Research is also conducted on how the provisions in UUPM No. 25/2007 give protection from the risk of foreign domination and the benefit principle deviation by finding and interpreting the provisions in UUPM No. 25/2007 that have the power of providing legal protection from such risk and deviation. The benefit principle is a principle, where the implementation of investment gives the greatest benefit for the welfare of the people, which is in line with Article 33(3) of the 1945 Constitution stipulating that “The earth and water and natural assets contained therein shall be controlled by the state and utilized for the greatest welfare of the peopleâ€. The research is conducted using normative legal approach. Provisions in UUPM No. 25/2007 are connected with the value of utility and efficiency that they possibly produce and the welfare objective pursuant to the benefit principles adopted by the constitution. Research is also conducted on how the provisions in UUPM No. 25/2007 give protection from the risk of foreign domination and the benefit principle deviation by finding and interpreting the provisions in UUPM No. 25/2007 that have the power of providing legal protection from such risk and deviation. The interpretation and reasoning upon the review concerning the consistence and legal protection in question is conveyed logically and analytically following legal discipline steps. The outcomes show that UUPM No. 25/2007 has consistently been directed to the welfare objective pursuant to the benefit principles and the 1945 constitution and providing legal prevention from foreign domination by stipulating obligatory provisions for the investor to perform economic and social responsibility.
