Tinjauan Yuridis Asas Bezziter the Goeder Throuw dalam lelang eksekusi hak tanggungan

Asas Bezziter the Goeder Throuw adalah asas penguasaan benda yang dilakukan secara jujur atau tidak melawan hukum. Dikatakan demikian karena pada dasarnya asas ini diperoleh dengan cara-cara memperoleh hak milik. Pada pelaksanaan asas Bezziter The Goeder Throuw dalam Lelang Eksekusi Hak Tanggungan, selalu dikaitkan dengan kepemilikan benda yang akan dilelang. Apabila kepemilikan atas benda lelang diperoleh dengan cara yang jujur maka perolehannya dikatakan sebagai Bezziter The Goeder Throuw namun apabila perolehannya dilakukan secara tidak jujur atau melawan hukum yang mengandung unsur melawan hukum (Onrehctmatigedaad) maka penguasaan tersebut dikatakan sebagai Asas Bezziter The Kwarder Throuw. Perlindungan hukum bagi pemilk sah benda lelang dalam pelaksanaan lelang eksekusi Hak Tanggungan dibagi atas dua yaitu perlindungan penuh dan perlindungan tidak penuh. Perlindungan penuh apabila hak miliknya dikuasai secra tidak jujur oleh pihak lain maka pemilik sah akan dilindungi secara penuh berupa pengembalian benda kepada pemilik sebenarnya. Namun apabila pemilik sah sendiri yang melakukan perikatan dengan Kreditur maka dalam pelelangan pemilik sah hanya mendapat perlindungan tidak penuh. Bentuk perlindungan tersebut berupa pengembalian uang kelebihan dari hasil penjualan lelang setelah dikurangi seluruh hutang dan pajak.

Soles in the public (auction) is written in the article 5 of UUD 1945. later it is shawn in it’s implementation rules. Auction is devided in to 2 kinds that is execution auction and non-execuition auction. In this thesis will disscuse only abaut execution auction that has the object of the right of duty plece the creditor in the main position to get the property right of duty place the creditor in the main position to get the property right where ever the properties are (droit de suit). But in the implemntation of execution auction some problem arise abaut the fredom of the property and the object of the auction. It cause the apperiance of Beziter The Goeder Throuw Throun principles. The probklems that’s appear in the implementation of execution auction always connect with the legality of the element of violating the law onrechtmatigedaad. To aviod the problems above article 14 PMK 41/PMK/07/2006 abaut the auction functionary who gives power to the other functionary to do research of the auction requirement document. This things is needed to protect the right of the thrid people who was a good aim. In the conections with the law protection that is given to Bezitter The Goeder Throuw in execution auction the right of duty is devided into 2, that is limited protection if the legal owner contribute or know abaut the credit agreement wich is done by himself and this power the others is full protection if the legal ownewr has been violated in this rights and can be proofed by juridiction.
