Penelitian mengenai Perlindungan Hukum Terhadap Konsumen yang Membeli Rumah yang Dibangun oleh Pengembang di Kota Tarakan ini merupakan penelitian dengan pendekatan yuridis normatif. Penelitian ini bertujuan untuk mengetahui perlindungan hukum dan kedudukan konsumen serta pengembang dalam bisnis property, penyebab pengembang tidak memenuhi janji-janji secara utuh, upaya yang ditempuh konsumen di dalam bisnis property di Kota Tarakanuntuk mendapatkan perlindungan hukum. Penelitian dilakukan di Kota Tarakan dengan mengambil sampel pengembang atau developer dan konsumen perumahan. Sampel ditentukan secara secara purposive, yaitu sampel yang dihubungi adalah sampel yang sesuai dengan kriteria tertentu yang ditetapkan berdasar tujuan penelitian. Hasil penelitian menunjukkan bahwa pengembang tidak dapat memenuhi janjinya karena terbatasnya lahan yang dapat dibangun, sehingga ada pengembang yang lokasinya berada di lahan kritis dan mudah tergerus air bila hujan (daerah erosi). Masalah lain adalah lambatnya pelayanan instansi terkait yang melayani pemasangan seperti listrik, air minum/air bersih dan telepon. Dalam menyelesaikan sengketa atau kesalahpahaman yang terjadi antara pihak konsumen dengan pengembang dapat ditempuh cara mengajukan secara perdata ke Pengadilan Negeri, negosiasi/musyawarah; atau melalui lembaga mediasi. Di Kota Tarakan Responden lebih suka menggunakan pendekatan musyawarah dalam menyelesaikan masalah kesalahpahaman diantara kedua belah pihak.

The research dealing with the Legal Protection on Consumers buying Houses built by Developers in Tarakan City was judicial normative in nature. It aimed to discover the legal protection and consumers' and developers' positions in real estate business, the causes of developers for not fulfilling their promises, and efforts made by the consumers to gain legal protection. The research was conducted in Tarakan City by taking samples which included developers and consumers. The samples were determined purposively. The results of research showed that the unfulfilled facilities, such as electricity, drinking water and telephone lines were not the responsibilities of the developers because the developers had paid for those things to the related government agency. Even if there was a problem, it was the problem which existed between bank and the consumers regarding the unpaid installments and the resolutions were beyond the developers' responsibilities. In resolving dispute or misunderstanding occurring between consumers and developers, negotiations could be resorted. Respondents preferred discussions (musyawarah) in solving the problems. Other means of dealing with the problems was by mediation; a common solution practised by mediating institutions. From the research, it could be concluded that in fact there was no problem between developers and consumers because as soon as the house had been built, the transfer of property was conducted immediately to the consumers. Since then, the relationship between consumers and developers was over. In resolving disputes, negotiations by mediations could be implemented
