Perbandingan Hak dan Kewajiban Hukum antara Pegawai Pemerintah dengan Perjanjian Kerja

Penelitian ini bertujuan untuk mengetahui dan menganalisis kedudukan hukum dari Aparatur Sipil Negara yang terdiri dari Pegawai Negeri Sipil (PNS) dan Pegawai Pemerintah dengan Perjanjian Kerja (PPPK) dan Pegawai Pemerintah Non Pegawai Negeri (PPNPN) atau tenaga honorer yang merupakan pegawai pemerintah non ASN setelah disahkannya Undang-Undang Nomor 5 tahun 2014 (UU ASN) dan Peraturan Pemerintah Nomor 96 Tahun 2018 (PP Manajemen PPPK) serta mendapatkan gambaran mengenai hak dan kewajiban yang diterima oleh Aparatur Sipil Negara dan perbandingannya dengan hak dan kewajiban yang melekat pada Pegawai Pemerintah Non Pegawai Negeri atau tenaga honorer. Metode penelitian yang digunakan dalam penelitian ini adalah normatif komparatif. Penelitian dilakukan dengan menggunakan sumber data yang diperoleh dari penelitian kepustakaan untuk data sekunder, dan penelitian lapangan berupa wawancara guna menunjang data kepustakaan tersebut. Data yang diperoleh dianalisis dengan pendekatan kualitatif secara komparatif, sehingga mendapatkan kesimpulan penelitian. Hasil penelitian menunjukan: Pertama, berlakunya UU ASN dan peraturan pelaksanaannya yakni PP Manajemen PPPK, menempatkan status PNS dan PPPK berkedudukan hukum sebagai ASN namun di sisi lain menciptakan suatu ketidakpastian hukum terhadap PPNPN atau tenaga honorer terkait status dan kedudukan hukumnya sebagai pegawai pemerintah. Kedua, masih terdapat kesenjangan yang kontras tajam di dalam perbandingan antara PNS dan PPPK sebagai ASN dengan PPNPN sebagai pegawai pemerintah Non ASN terkait hak dan kewajiban yang melekat pada masing-masing entitas tersebut di mana PPNPN menerima hak yang jauh di bawah ASN terlepas dari beban kerja yang sama.

This research aims to determine and to analyze the legal standing of state�s civil apparatus which consists of civil servants and government�s employees by contract, and also the opposite of those two entities; the goverment�s non official emplyoyees or honorary workers following the enacment of Law No. 5 of 2014 on State Civil Apparatus and Goverment regulation No.96 of 2018 on the management of Goverment�s employee by contract. This research also aims to potray the reality of the rights and obligations given by the law to those entities through comparison between the state official employee�s and the state unofficial employee�s. The research methods that are used in this study are normative-comparative methods which is conducted by using data resources obtained from literature review for secondary data and research on field through interviews with correspondents related to the topic to support the literature study. The gathered datas then were analyzed with qualitative approach in comparative fashion to get a conclusion out of the research. The results of the research are: First, the State Civil Aparatus Law and its implenting regulation that is Goverment regulation No.96 of 2018 on the management of Goverment�s employee by contract has given Civil Servants and Goverment�s employee by contract the legal standing as a part of state civil apparatus yet at the same time has created a legal insecurity towards the goverment�s non official emplyoyees or honorary workers related to their status and legal standing as the government�s employee. Second, there is still a contrast gap between the rights and obligations of State Civil Aparatus and the goverment�s non official emplyoyee�s whereas the latter are entitled to far lesser rights than the former despite of the same kind of workload between the two.
