TUMPANG TINDIH REGULASI TERKAIT SERTIFIKASI CATU DAYA (GENSET) DI BANDAR UDARA

Sistem catu daya kelistrikan merupakan salah satu fasilitas di bandar udara yang berhubungan dengan keselamatan operasi penerbangan. Salah satu peralatan catu daya adalah generator set. Bedasarkan Peraturan Menteri Perhubungan nomor PM 77 Tahun 2015, Direktorat Jenderal Perhubungan Udara melaksanakan sertifikasi kalaikan fasilitas Bandar Udara salah satunya berupa peralatan generator set diseluruh bandar udara dalam wilayah negara Indonesia. Instansi lain dengan dasar Peraturan Menteri Energi dan Sumber Daya Mineral nomor 38 Tahun 2018 menyatakan Setiap instalasi penyediaan tenaga listrik (genset) wajib memiliki Sertifikat laik operasi. Hal ini menyebabkan permasalahan hukum terkait implementasi regulasi ketenagalistrikan di bandar udara. Berdasarkan hal tesebut, penelitian ini membahas permasalahan Bagaimana tumpang tindih Sertifikasi Catu Daya (genset) di bandar udara menurut Peraturan Menteri Perhubungan nomor PM 77 Tahun 2015 dengan Peraturan Menteri Energi dan Sumber Daya Mineral nomor 38 Tahun 2018 dan Peraturan Menteri Energi dan Sumber Daya Mineral nomor 12 Tahun 2019 dan Bagaimana Implikasi diberlakukannya Undang-Undang Cipta Kerja terhadap Pengaturan Sertifikasi catu daya (genset) di bandar udara. Penelitian ini bersifat normatif untuk permasalahan pertama, normatif � empiris dengan data sekunder dan data primer untuk permasalahan kedua. Analisa data secara kualitatif dengan metode deduktif. Hasil anailis disajikan secara deskriptif. Hasil penelitian menunjukkan pertama sebelum Undang � Undang Cipta Kerja diundangkan, terjadi tumpang tindih pengaturan sertifikasi Catu daya (genset) di bandar udara baik itu objek dan kewenangan serta terjadi ketidakharmonisan antara kewenangan pemerintah daerah (gubernur) dengan pemerintah pusat (Kementerian Perhubungan) terkait kewenangan pemda dalam hal meregistrasi sertifikat laik operasi genset di bandar udara. Kedua Setelah Undang � Undang Cipta Kerja terdapat dampak bagi sertifikasi catu daya (genset) yaitu dari sisi sub sektor ketenagalistrikan posisi sertifikat laik operasi diperkuat dan Sertifikat laik operasi diregistrasi melalui Direktur Jenderal Ketenagalistrikan (Dirjen Gatrik), sektor penerbangan sertifikasi kelaikan fasilitas bandar udara di hapus dan diganti dengan verifikasi. Implementasi sertifikasi laik operasi oleh peraturan ketenagalistrikan di bandar udara akan tetap menimbulkan potensi tumpang tindih ketika peralatan genset wajib di verifikasi oleh Direktorat Jenderal Perhubungan Udara dan juga wajib sertifikasi laik operasi oleh lembaga inspeksi teknik.

The electrical power supply system is one of the facilities in the aerodrome related to the safety of flight operations. One of the power supply equipment is the generator set. Based on Ministry Decree of Transportation 77 of 2015, the Directorate General of Civil Aviation carries out certification for Aerodrome facilities, one of which is that of generator set equipment for all aerodrome within the territory of Indonesia. Other agencies based the Ministry decree of Energy and Mineral Resources number 38 of 2018 stipulate that every electricity supply installation (genset) must have a certificate of operational worthiness. This causes legal problems related to the implementation of Energy and Mineral Resources regulations at airports. Based on this, this research discusses the problem of how overlapping Power Supply Certifications (gensets) in airports according to the Ministry Decree of Transportation number 77 of 2015 which collides to the Minister of Energy and Mineral Resources Decree numbers 38 of 2018, and 12 of 2019 and how the implication of the Cipta kerja act on the Certification Arrangement of power supply (genset) in aerodromes This research is normative for the first problem, normative - empirical with secondary data and primary data for the second problem. The data analized qualitatively by using deductive method. The results of the analysis are presented in the descriptive way. The results of research firstly show that before cipta kerja act was promulgated, there was an overlapping arrangements regarding power supply (genset) certification at the aerodrome both in terms of object and authority. There was disharmony between the authority of the local government (governor) and the central government (Ministry of Transportation) regarding the authority of the regional government in terms of registering a certificate of operation worthiness for generator sets in airports. Secondly, after the Cipta Kerja Act promulgated, there was an impact on the power supply (genset) certification, in terms of the electricity sub-sector, whereas the position of the operational-worthy certificate is strengthened and the Certificate operation Worthiness is registered by Minister through the Director General of Electricity. Meanwhile in aviation sector, the airport facility-worthiness certification is currently deleted and replaced by verification. Thusly, implementation of operation-worthy certification of electricity regulations for airports will continue to cause potential overlap due to both the necessity of generator set equipment to be verified by the Directorate General of Civil Aviation and the requirement to be operational-worthy certificated by technical inspection agencies.
