ASPEK KONSTITUSIONAL JABATAN WAKIL PRESIDEN DALAM SISTEM PEMERINTAHAN DI INDONESIA

Dalam Sistem Ketatanegaraan Indonesia, wakil presiden merupakan jabatan yang strategis dan atraktif sehingga dapat menentukan arah perpolitikan dalam pemilihan umum presiden dan wakil presiden 2019 serta diminta agar tidak dibatasi masa jabatannya. Bertolak dari fakta tersebut, penelitian ini ingin mengungkapkan bagaimana sebenarnya kedudukan dan kewenangan konstitusional jabatan wapres dalam sistem pemerintahan di Indonesia? mengapa jabatan wapres mengalami dinamika dalam sistem pemerintahan yang sama? serta, apakah desain konstitusional jabatan wapres sudah ideal? Guna menyelusuri, menemukan, mengungkapkan, menganalisis serta merumuskan peran wapres tersebut di atas, dilakukan penelitian hukum normatif, preskriptif, dan komparatif. Penelitian ini dilengkapi dengan wawancara untuk mengonfirmasi dan menglarifikasi data sekunder, baik itu bahan hukum primer, sekunder, maupun tersier, yang dikumpulkan melalui studi pustaka. Data yang telah dipilah, dikonfirmasi, dan diklasifikasi serta dianalisis secara kualitatif dengan menggunakan metode deskriptif-preskriptif. Berdasarkan hasil penelusuran, penemuan, pengungkapan, serta penganalisis data yang diperoleh, wapres di Indonesia mempunyai kedudukan dan kewenangan konstitusional sebagai pembantu presiden. Pembantuannya dilakukan baik ketika presiden berhalangan maupun tidak. Ketika presiden tidak berhalangan, terjadi kedinamisan dalam peran-peran aktif sebagai pembantu presiden yang diemban oleh para wapres. Fluktuasi itu disebabkan karena pola pengisian jabatan tersebut, interpretasi atau pemahaman presiden atas makna kata "dibantu", kapabilitas wapres, kondisi presiden, serta kesepakatan di antara presiden dan wapres. Oleh karenanya, wapres di masa yang akan datang sebaiknya tetap diposisikan sebagai pembantu presiden, baik pembantuan secara aktif dalam pemerintahan sehari-hari maupun ketika presiden berhalangan.

The vice presidency is one of the strategic and attractive political positions in Indonesian's politic. So, it could dictate political direction in the 2019 Presidential and Vice-Presidential Elections. Even, it was also proposed to the Constitutional Court for not limiting the term of its office-holder. Based upon those facts, this research will reveal what does vice presidency's actual constitutional status and authority in Indonesian governmental system? Why does the vice presidency's authorities fluctuate in the same governmental system? and is the Indonesian vice presidency's constitutional design ideal? In order to find, reveal, analyze, and formulate the role of the vice president in Indonesia, a normative, prescriptive, and comparative legal research was conducted. The study was complemented by an interview to confirm and clarify secondary data, whether primary, secondary, or tertiary materials, which were collected through literature studies. The data that had been sorted, confirmed, and classified then analyzed qualitatively using descriptive-prescriptive methods. Based on data analyzation, it was found that, the status of vice president in Indonesian constitutional system was an assistant to the president. The assistance is accomplished when the president is unavailable or not. When the president is available, there were fluctuate governmental authorities that was delegated to the vice presidents. The fluctuation was caused by the electoral model of the vice presidency, the president's interpretation or understanding to the meaning of "assisted", the vice president's capabilities, the president's physical condition, and the agreement between the president and the vice president before they came to the offices. Therefore, it is proposed that the ideal status of the Indonesian vice presidency remains the same, whether actively assist the president in daily governmental activities or when the president is unavailable.
