Pelindungan Hak Ekonomi Usaha Mikro Kecil Menengah (UMKM) pada Era Regional Comprehensive Economic Partnership (RCEP) dalam Perspektif Hak Asasi Manusia (HAM): Studi pada UMKM Sektor Konveksi di Jawa Tengah

Penelitian Tesis ini bertujuan untuk mengetahui, menganalisis dan menjelaskan pelindungan hak ekonomi bagi UMKM Sektor Konveksi di Jawa Tengah dalam menghadapi RCEP dalam perspektif hak asasi manusia. Selain itu penelitian ini juga bertujuan untuk mengetahui, menganalisis, dan menjelaskan konsep ideal pelindungan hak ekonomi bagi pelaku UMKM Sektor Konveksi di Jawa Tengah kedepannya. Metode Penelitian yang digunakan pada penelitian tesis kali adalah jenis penelitian yuridis empiris, adapun yang dimaksud dengan penelitian yuridis empiris adalah satu jenis penelitian yang dilakukan dengan menelusuri serta mengkaji berbagai data sekunder yang meliputi peraturan perundang-undangan yang berlaku dimasyarakat serta didukung data primer dengan melakukan penelusuran fakta yang terjadi dimasyarakat. Penulis mendapati dua kesimpulan pada penelitian tesis kali ini yang meliputi: Pertama, Pemerintah belum optimal memberikan pelindungan hak ekonomi bagi UMKM Sektor Konveksi di Jawa Tengah yang dibuktikan dari pelindungan hak ekonomi yang hanya terbatas pada upaya normatif seperti mengatur pelindungan hak ekonomi UMKM dalam peraturan perundang-undangan. Sekalipun telah diatur, namun masih terdapat norma yang belum ramah terhadap UMKM Sektor Konveksi di Jawa Tengah, yaitu perihal bidang usaha penanaman modal yang dialokasikan untuk UMKM. Selain itu, juga terdapat pertentangan antara jawaban dari Dinas Koperasi dan UMKM Jawa Tengah dan responden. Kedua, Dalam rangka terealisasinya pelindungan hak ekonomi bagi UMKM Sektor Konveksi di Jawa Tengah pada era RCEP, maka Pemerintah dalam memberikan pelindungan hak ekonomi bagi UMKM Sektor Konveksi di Jawa Tengah harus berkesesuaian dengan norma hukum nasional dan internasional serta mengikuti panduan pada Teori Hukum dan HAM serta Teori Negara Kesejahteraan secara komprehensif.

This Thesis research is aims to identify, analyze, and explain the protection of economic rights for MSMEs in the Convection Sector in Central Java in the face of RCEP in the human rights perspective. Furthermore, this study is also aims to find out, analyze, and explain the ideal concept of protection of economic rights in MSMEs in the Convection Sector in Central Java in the future. The research method that used in this thesis is a type of empirical juridical research, while empirical juridical research is type of research that conducted by tracing dan reviewing various secondary data which including laws dan regulations that apply in society and supported by primary data by conducting searches the fact that occur in society. The authors finds two conclusions in this thesis research which include: First, the government has not optimally provided protection of economic rights for MSMEs in the Convection Sector in Central Java as evidenced by the protection of economic rights which only limited on normative efforts such as regulating the economic rights of MSMEs in laws and regulations. Even though it has been regulated, there are still norms that are not friendly for MSMEs in the Convection Sector in Central Java, namely regarding the business investment field that allocated to MSMEs. Furhermore, there is also a conflict between the answers from the Central Java Cooperatives and MSMEs Service. Second, in order to realize the protection of economic rights for MSMEs in the Convection Sector in Central Java to face RCEP era, the Government in providing the protection of economic rights for MSMEs in the Convection Sector in Central Java must comply with national dan international legal norms and follow the guidelines in the Theory of Human Rights and Theory of Welfare State.
