PEMODELAN TIPOLOGI KADASTER MENUJU KADASTER LENGKAP INDONESIA

Kadaster lengkap didefinisikan sebagai informasi spasial berbasis bidang tanah yang mencakup suatu wilayah tertentu mengenai hak (rights), batasan (restrictions) dan tanggung jawab (responsibilities) yang melekat di atas bidang tanah tersebut. Kadaster lengkap merupakan motor penggerak sistem administrasi pertanahan untuk mewujudkan pembangunan berkelanjutan (Williamson, dkk., 2010). Namun demikian, menurut Eng (2018), setelah 200 tahun dibangun, kadaster di Indonesia masih belum lengkap. Joko Widodo, Presiden Republik Indonesia, menyebutkan ketimpangan terhadap kelengkapan tersebut, yaitu bahwa jumlah bidang tanah yang terdaftar sampai dengan tahun 2016 baru sebanyak 46 juta dari 126 juta bidang tanah di seluruh Indonesia. Selanjutnya, berdasarkan penjelasan Peraturan Pemerintah Nomor 24 Tahun 1997 tentang Pendaftaran Tanah, terdapat pertambahan jumlah bidang tanah setiap tahunnya sebanyak 3,6 juta bidang tanah. Dengan demikian, diperkirakan bahwa jumlah bidang tanah pada tahun 2022 menjadi sebanyak 143,7 juta bidang tanah. Merujuk data Kementerian ATR/BPN tahun 2022, bidang tanah terdaftar sebanyak 80,3 juta bidang, atau baru sekitar 55,9%. Lebih lanjut, peta bidang dari tanah yang sudah terdaftar tersebut, belum semuanya memenuhi standar teknis elemen kadaster yang ditetapkan (KATR/BPN, 2019). Hal ini dikarenakan ketidakpatuhan dalam pemenuhan standar teknis fixed boundary dalam regulasi penetapan batas, yang dalam penelitian ini disebut elemen-elemen kadaster. Hingga saat ini, belum terdapat indikator yang menggambarkan tingkat kepatuhan peta bidang tanah terhadap elemen kadaster yang ditetapkan dalam regulasi penetapan batas dimaksud. Dalam konteks kadaster lengkap, penelitian ini berfokus pada informasi mengenai hak (rights) dalam kegiatan pendaftaran tanah. Penelitian ini bertujuan untuk menyusun suatu indikator kepatuhan sekaligus baseline peningkatan kualitas data kadaster untuk membangun kadaster lengkap. Studi kasus penelitian ini dilakukan pada enam desa di Kabupaten Madiun dan dua kelurahan di Kota Administrasi Jakarta Utara. Wilayah Kabupaten Madiun dipilih untuk merepresentasikan daerah perdesaan yang mayoritas bidang tanahnya belum secara legal bersertipikat, sehingga hanya aktivitas legal yang diteliti. Sementara, wilayah Kota Administrasi Jakarta Utara dipilih untuk menggambarkan daerah perkotaan yang mayoritas bidang tanahnya sudah secara legal bersertipikat, sehingga hanya aktivitas spasial yang diteliti. Penelitian ini menggunakan metode kualitatif dan kuantitatif. Metode kualitatif diawali dengan wawancara terhadap pengambil kebijakan sebagai data primer untuk mengidentifikasi sistem kadaster di Indonesia. Untuk merumuskan elemen-elemen kadaster dalam kegiatan penetapan batas, dilakukan studi regulasi. Berdasarkan elemen-elemen kadaster tersebut disusun suatu indikator untuk mengevaluasi tingkat kepatuhannya secara kuantitatif dengan menggunakan tools pada perangkat sistem informasi geografis. Selanjutnya dilakukan analisis penyebab tidak lengkapnya kadaster di Indonesia berdasarkan hasil-hasil penelitian tersebut. Untuk mengkonfirmasi hasil analisis, dilakukan wawancara secara acak terhadap masyarakat penerima sertipikat dan praktisi di kantor pertanahan pada dua lokasi studi. Hasil penelitian ini menyajikan secara komprehensif kondisi kadaster di dua lokasi studi. Penelitian juga merumuskan elemen-elemen kadaster berdasarkan regulasi penetapan batas yang terdiri dari elemen legal dan elemen spasial (Arruñada 2018). Elemen legal terdiri dari penunjuk batas, persetujuan batas dan tanda batas, sedangkan elemen spasial terdiri dari petugas penetapan batas, metode pengukuran, dan ketelitian peta dasar. Tipologi kadaster sebagai temuan penelitian ini disusun sebagai indikator untuk menggambarkan tingkat kepatuhan setiap peta bidang tanah terhadap tiga elemen legal dan tiga elemen spasial. Secara keseluruhan tingkat kepatuhan menunjukkan hasil sebagai berikut: 1) penunjuk batas sebesar 96,4%; 2) persetujuan batas sebesar 96,6%; dan 3) tanda batas sebesar 92,5% (walaupun hanya 65,8% yang memasang tanda batas secara permanen) pada enam desa di Kabupaten Madiun. Sementara itu, di dua kelurahan Kota Administrasi Jakarta Utara ditemukan bahwa tingkat kepatuhan peta bidang tanah terhadap tiga elemen spasial yaitu: 1) petugas penetapan batas sebesar 100%; 2) metode pengukuran sebesar 17,4%; dan 3) ketelitian peta dasar sebesar 0%. Berdasarkan hasil tersebut, terlihat bahwa persyaratan teknis penetapan batas yang cukup tinggi menyebabkan tidak mudahnya pemenuhan syarat fixed boundary. Faktor penentu dari elemen legal adalah tingkat partisipasi pemegang hak dalam kegiatan pendaftaran tanah. Sedangkan faktor penentu dari elemen spasial adalah ketersediaan peta dasar untuk memetakan peta bidang tanah yang memenuhi standar teknis. Penelitian ini memberikan rekomendasi perlunya penelitian untuk menguji bahwa general boundary lebih cocok untuk diterapkan dalam membangun kadaster lengkap di seluruh wilayah Indonesia.

A complete cadastre is defined as spatial information based on land parcels covering a specific jurisdiction regarding the rights, restrictions, and responsibilities attached to the land parcel. A complete cadastre drives the land administration system to achieve sustainable development (Williamson et al., 2010). However, according to Eng (2018), after 200 years of construction, the cadastre in Indonesia is still incomplete. Joko Widodo, President of the Republic of Indonesia, stated that in 2016 the number of registered land parcels was 46 million out of 126 million land parcels throughout Indonesia. Moreover, based on Government Regulation 24 of 1997 concerning Land Registration, there is an increase in land parcels yearly, as much as 3.6 million. Thus, it is estimated that the number of parcels in 2022 will be as many as 143.7 million. Referring to data from the Ministry of ATR/BPN in 2022, there are 80.3 million registered land parcels or only around 55.9%.Furthermore, not all of the registered land parcels comply with the cadastre elements' technical standards (KATR/BPN, 2019). This problem could happen due to non-compliance in fulfilling fixed boundary technical standards in boundary determination regulations, called cadastre elements in this study. Until now, no indicators describe the level of compliance of the land parcel map with the cadastre elements stipulated in the regulation on determining the boundary. In the context of a complete cadastre, this research focuses on the information on rights in land registration activities. This study aims to develop an indicator of compliance and a baseline for improving the quality of cadastre data to build a complete cadastre. The case study was conducted in six villages in Madiun Regency and two sub-districts in North Jakarta Administrative City. The Madiun Regency area was chosen to represent rural areas where most land parcels have not been legally certified, so only legal activities were investigated. Meanwhile, the North Jakarta Administrative City area was chosen to describe urban areas where most land parcels are legally certified so that only spatial activities are investigated. This research uses qualitative and quantitative methods. The qualitative process begins with the interviews to the policymakers as primary data to identify the cadastre system in Indonesia. Then, a regulatory study is conducted to formulate cadastre elements in boundary determination activities. Based on these cadastre elements, an indicator of compliance is prepared to evaluate the level of compliance quantitatively by using tools on the geographic information system application. Furthermore, an analysis of the causes of the incomplete cadastre in Indonesia is carried out based on the results of these studies. Finally, random interviews were conducted with land certificate recipients and practitioners at the land office at the two study locations to ensure the investigation results. The results of this study comprehensively present the cadastre conditions in the two study locations. The research also formulates cadastre elements based on boundary determination regulations consisting of legal and spatial elements (Arruñada 2018). The legal elements include the parties that locate the boundary, agreement between the adjoining landowners, and boundary markers. In contrast, the spatial elements consist of boundary determination officers, measurement methods, and the accuracy of the base map. The cadastre typology as the finding of this research is compiled as an indicator the level of compliance of each land parcel map with three legal elements and three spatial elements. Overall the level of compliance shows the following results: 1) the parties that locate the boundary of 96.4%; 2) agreement between the adjoining landowners of 96.6%, and 3) boundary markers of 92.5% (although only 65.8% have permanently marked boundary) in six villages in Madiun Regency. Meanwhile, in two sub-districts of the North Jakarta Administrative City, it was found that the level of compliance of land parcel maps with three spatial elements, namely: 1) boundary determination officers was 100%; 2) measurement method by 17.4%; and 3) the accuracy of the base map is 0%. Based on these results, the technical requirements for determining boundary are pretty high, making it challenging to fulfill the fixed boundary requirements. The most significant factor of the legal element is the level of participation of right holders in land registration activities. In comparison, the essential aspect of the spatial element is the availability of a base map that meet the technical standards. This study recommends the need for further research to test that the general boundary is more suitable to be applied in building a complete cadastre.
