IMPLEMENTASI PASAL 6 PERATURAN PERKUMPULAN IKATAN NOTARIS INDONESIA NOMOR : 22/PERKUM/INI/2021 TENTANG PENDAFTARAN ANGGOTA LUAR BIASA IKATAN NOTARIS INDONESIA DI KOTA GORONTALO

Penelitian hukum ini bertujuan untuk menganalisis dan memahami mengapa besaran nominal biaya Seleksi Anggota Luar Biasa Ikatan Notaris Indonesia di Kota Gorontalo lebih besar dari ketentuan Pasal 6 PERKUM INI NO: 22/PERKUM/INI/2021 serta untuk mengetahui dan memahami peranan Pengurus Ikatan Notaris Indonesia dalam penegakan pasal tersebut. Penelitian ini merupakan penelitian yang dilakukan dengan menggunakan metode penelitian normatif empiris. Sumber yang digunakan adalah data primer dan data sekunder. Alat penelitian yang digunakan adalah wawancara dengan narasumber. Data yang diperoleh lalu dianalisis secara kualitatif dengan cara mengkaji data didasarkan pada pemhaman dan pengolahan data secara sistematis yang diperoleh dari hasil wawancara, sehingga menghasilkan suatu kesimpulan yang kemudian diuraikan secara deskriptif. Kesimpulan yang diperoleh dari penelitian ini adalah 1. Faktor yang membuat besaran nominal biaya Seleksi Anggota Luar Biasa Ikatan Notaris Indonesia di Kota Gorontalo lebih besar dari Ketentuan Pasal 6 PERKUM INI Nomor : 22/PERKUM/INI/2021, adalah akomodasi-akomodasi yang dibutuhkan demi terlaksananya Seleksi ALB tersebut. Akomodasi tersebut antara lain penyewaan hotel sebagai lokasi pelaksanaan serta biaya-biaya lainnya menyangkut pencegahan penyebaran virus Covid-19 yang dibutuhkan dalam penyelenggaraan Seleksi ALB tersebut. Dimana akomodasi tersebut tidak dapat diperoleh dengan pembebanan biaya yang ditentukan oleh Pasal 6 PERKUM INI Nomor : 22/PERKUM/INI/2021. Namun demikian, adanya penambahan biaya di luar dari ketentuan Pasal 6 tersebut, keberadaannya menjadi pro dan kontra. 2. Pengurus Pusat tidak berwenang dalam mengambil tindakan terhadap adanya pelanggaran Pasal 6 mengingat dalam PERKUM INI Nomor : 22/PERKUM/INI/2021 itu sendiri tidak mengatur mengenai adanya sanksi apabila Pasal 6 dilanggar dan tidak juga mengatur peran Pengurus Pusat terhadapnya. Peran pengurus terkait PERKUM INI Nomor : 22/PERKUM/INI/2021 adalah sebagai pihak yang menetapkan peraturan tersebut. Kata Kunci : Anggota Luar Biasa, Notaris, Ikatan Notaris Indonesia.

This legal research aims to analyze and understand why the nominal fee for the Selection of Extraordinary Members of the Indonesian Notary Association in Gorontalo City is greater than the provisions of Article 6 PERKUM INI NO: 22/PERKUM/INI/2021 and to know and understand the role of the Indonesian Notary Association in enforcement of the article. This research is a research conducted using empirical normative research methods. The sources used are primary data and secondary data. The research tool used is interviews with resource persons. The data obtained were then analyzed qualitatively by reviewing the data based on the understanding and systematic processing of data obtained from interviews, so as to produce a conclusion which was then described descriptively. The conclusions obtained from this study are 1. The factors that make the nominal fee for the Selection of Extraordinary Members of the Indonesian Notary Association in Gorontalo City greater than the provisions of Article 6 PERKUM INI Number: 22/PERKUM/INI/2021, are the accommodations needed for implementation of the ALB Selection. The accommodation includes hotel rentals as the location for the implementation as well as other costs related to preventing the spread of the Covid-19 virus which is needed in holding the Extraordinary Selection. Where the accommodation cannot be obtained by charging the fees determined by Article 6 PERKUM INI Number: 22/PERKUM/INI/2021. However, there are additional costs outside of the provisions of Article 6, its existence is both a pro and a con. 2. The Central Management is not authorized to take action against violations of Article 6 considering that PERKUM INI Number: 22/PERKUM/INI/2021 itself does not regulate the existence of sanctions if Article 6 is violated and does not also regulate the role of the Central Management towards it. The role of the management regarding PERKUM INI Number: 22/PERKUM/INI/2021 is as the party that establishes the regulation. Keywords : Extraordinary Members, Notary, Indonesian Notary Association.
