Penerapan Asas Tabellionis Officium Fideliter Exercebo Bagi Notaris Dalam Memberikan Pelayanan Di Era Society 5.0

Penelitian ini dilakukan dengan tujuan untuk mengetahui dan menganalisis lebih dalam terkait dengan Penerapan asas Tabellionis Officium Fideliter Exercebo Bagi Notaris Dalam Memberikan Pelayanan di Era Society 5.0, dan mengetahui dan menganalisis konsep dari asas Tabellionis Officium Fideliter Exercebo di era Society 5.0 serta kendala yang dihadapi Notaris. Penelitian ini menggunakan metode penelitian hukum yuridis empiris, yang melihat perilaku Notaris dan masyarakat terhadap hukum tidak tertulis. Sifat dari penelitian ini adalah penelitian deskriptif yaitu penelitian yang ditujukan untuk mendeskripsikan fenomena-fenomena yang ada. Metode pengumpulan bahan hukum yang digunakan yaitu studi pustaka (library research). Bahan yang diperoleh dilakukan analisis secara deskriptif kualitatif, yaitu setelah bahan terkumpul kemudian dituangkan dalam bentuk uraian logis dan sistematis, selanjutnya dianalisis untuk memperoleh kejelasan penyelesaian masalah yang akan diteliti untuk kemudian ditarik kesimpulan. Cara untuk mendapatkan informasi dari narasumber yang akan dituju dengan purposive sampling, penarikan wawancara yang bertujuan untuk mendalami permasalahan yang menjadi objek penelitian yang diperoleh langsung dari responden yang berkaitan dengan penulisan tesis Hasil penelitian menunjukkan bahwa asas Tabellionis Oficium Fedeliter Exercebo masih berkembang dan diimplementasikan meskipun telah mamsuki era society 5.0, terhadap konsep asas tersebut dikalangan Notaris tetap mempertahankan tradisi dan bekerja sesuai Undang-Undang, kendalanya dalam menghadapi era society 5.0 yang mengedepankan teknologi, terhadap kendala tersebut perlu adanya kesepahaman diantara Notaris dalam menjalakna kewenagannya di era society 5.0 hal ini karena beberapa pertuaran dan Penjelasan Pasal 15 ayat (3) UUJNP telah mendukung untuk terlaksananya cyber notary. Maka perlu adanya SOP atau aturan pelaksana bagi Notaris dalam memberikan pelayanan terutama dalam membuat akta di era society 5.0.

This research was conducted with the aim of knowing and analyzing more deeply related to the application of the Tabellionic Officium Fideliter Exercebo principle for Notaries in Providing Services in the Era of Society 5.0, and knowing and analyzing the concept of the Tabellionic Officium Fideliter Exercebo principle in the Society 5.0 era and the obstacles faced by Notaries. This research is empirical legal research, which looks at the behavior of Notaries and the public towards unwritten law. The nature of this research is descriptive research, namely research aimed at describing existing phenomena. The method of collecting legal materials used is library research. The material obtained was analyzed in a qualitative descriptive manner, ie after the material was collected it was then poured in the form of a logical and systematic description, then analyzed to obtain clarity on the resolution of the problem to be studied and then drawn conclusions. The way to get information from the source who will be addressed by purposive sampling, withdrawal of interviews which aims to explore the problems that become the object of research obtained directly from respondents related to thesis writing The results of the study show that the Tabellionis Oficium Fedeliter Exercebo principle is still developing and implemented even though it has entered the era of society 5.0, the concept of this principle among Notaries still maintains tradition and works according to the law, the obstacle is in facing the era of society 5.0 which puts forward technology, against these obstacles it is necessary there is an understanding between Notaries in carrying out their authority in the era of society 5.0 this is because several exchanges and explanations of Article 15 paragraph (3) UUJNP have supported the implementation of a cyber notary. So it is necessary to have an SOP or implementing rules for Notaries in providing services, especially in making deeds in the era of society 5.0.
