POTENSI PELINDUNGAN HUKUM INDIKASI GEOGRAFIS PADA PRODUK KOPI ROBUSTA MERAPI SLEMAN

Penelitian ini membahas tentang potensi dari produk Kopi Robusta Merapi Sleman untuk memperoleh pelindungan hukum Indikasi Geografis melalui pendaftaran produk terkait. yang diperoleh oleh produk Kopi Robusta Merapi Sleman melalui pendaftaran Indikasi Geografis. Penelitian bertujuan untuk mengetahui kemungkinan produk Kopi Robusta Merapi Sleman untuk memperoleh pelindungan hukum Indikasi Geografis dari potensi-potensi yang ada. Penelitian ini menggunakan metode normatif- empiris dengan studi pustaka dan wawancara dengan Responden. Penelitian kepustakaan dilakukan dengan menggunakan berbagai sumber termasuk tetapi tidak terbatas pada peraturan perundang-undangan, buku serta jurnal yang berkaitan. Wawancara Responden dilakukan kepada Kepala Subbidang Hukum dan Kekayaan Intelektual pada Kantor Wilayah Kementerian Hukum dan Hak Asasi Manusia Yogyakarta, Badan Perencanaan dan Pembangunan Daerah (Bappeda) Kabupaten Sleman dan Petani Kopi Robusta Merapi Sleman. Data yang telah diperoleh lalu diproses dalam penelitian ini menjadi pendekatan kualitatif dengan menggali sumber yang ada dan menganalisis data-data yang diperoleh. Hasil penelitian melalui pembahasan yang ada menunjukkan bahwa Kopi Robusta Merapi Sleman memiliki potensi untuk mendapat pelindungan Indikasi Geografis karena memiliki keterkaitan kuat dengan kondisi geografis yang mencakup faktor alam dan faktor manusia. Tantangan yang dihadapi dalam proses perwujudan Indikasi Geografis pada Kopi Robusta Merapi Sleman karena Indikasi Geografis merupakan hal yang baru bagi Pemerintah Kabupaten Sleman serta masih perlunya kesadaran dari petani Kopi Robusta Merapi Sleman untuk mengatasi kekurangan produksi dan penjagaan mutu Kopi Robusta Merapi Sleman agar sesuai dengan yang tercantum di dokumen deskripsi, serta Kantor Wilayah Kementerian Hukum dan Hak Asasi Manusia Yogyakarta yang berkoordinasi untuk mencegah potensi sengketa.

This study discusses the potential of Robusta Merapi Sleman Coffee products to obtain legal protection for Geographical Indications through registration of related products obtained by Robusta Merapi Sleman Coffee products through registration of Geographical Indications. This study aims to determine the possibility of Robusta Merapi Sleman Coffee to obtain legal protection for Geographical Indications from existing potentials. This study uses a normative-empirical method with literature studies and interviews with Respondents. Literature research is carried out using various sources, including but not limited to laws and regulations, related books, and journals. Interviews were conducted with the Head of the Legal and Intellectual Property Sub-Section at the Regional Office of the Ministry of Law and Human Rights Yogyakarta, the Regional Planning and Development Agency (Bappeda) of Sleman Regency, and Robusta Merapi Sleman Coffee. The data that has been obtained is then processed in this study into a qualitative approach by exploring existing sources and analyzing the data obtained. The research results through the existing discussion show that Robusta Merapi Sleman Coffee has the potential to receive Geographical Indication protection because it has a strong relationship with natural factors and human factors. The challenges faced in the process of realizing Geographical Indications in Robusta Merapi Sleman Coffee, because Geographical Indications are new for the Sleman Regency Government, maintaining awareness is still the need for Robusta Merapi Sleman Coffee farmers to overcome production shortages and maintain the quality of Kopi Robusta Merapi Sleman to match what is expected listed in the description document. Also, coordinating Regional Office of the Ministry of Law and Human Rights Yogyakarta to prevent potential disputes.
