PRAKTIK KERJA SAMA NOTARIS DENGAN KOPERASI SIMPAN PINJAM DAN PEMBIAYAAN SYARIAH BAITUL MAAL WAT TAMWIL BERINGHARJO YOGYAKARTA

Koperasi Simpan Pinjam dan Pembiayaan Syariah (KSPPS) Baitul Maal Wat Tamwil (BMT) Beringharjo adalah sebuah badan usaha berbadan hukum koperasi yang membutuhkan jasa Notaris. Kerja sama Notaris dengan KSPPS BMT Beringharjo diduga berpotensi melanggar Kode Etik Notaris, karena pada dokumen yang diberikan Notaris sebagai syarat administrasi terdapat surat lamaran yang isinya sama dengan surat permohonan kerja sama. Berdasar hal tersebut penulis tertarik untuk melakukan penelitian. Tujuan dari penelitian ini adalah untuk menjelaskan latar belakang praktik kerja sama antara Notaris dengan KSPPS BMT Beringharjo, menguraikan dan menganalisis praktik kerja tersebut ditinjau dari Kode Etik Notaris, menjelaskan peranan dari MPD, dan memaparkan peranan DKD dalam hal penegakan Kode Etik Notaris. Jenis penelitian ini adalah yuridis empiris, menggunakan jenis data primer yang diperoleh dari penelitian lapangan dengan tehnik wawancara kepada subjek penelitian, dan data sekunder yang diperoleh dari studi kepustakaan. Subjek penelitian yang terlibat adalah 9 (sembilan) orang responden dan 3 (tiga) orang narasumber. Sifat dari penelitian ini adalah deskriptif dan menggunakan metode analisis data kualitatif. Hasil dari penelitian ini adalah pertama, praktik kerja sama antara KSPPS BMT Beringharjo dengan Notaris dilatarbelakangi adanya kebutuhan KSPPS BMT Beringharjo atas keamanan pembiayaan yang disediakannya dan adanya fungsi jabatan yang melekat pada Notaris. Kedua, surat lamaran bisa dipersamakan dengan permohonan kerja sama, maka pemberian surat lamaran berpotensi melanggar kode etik. Ketiga, MPD Kulon Progo melakukan pengawasan dan pembinaan setiap saat terutama saat pemeriksaan protokol Notaris, pemeriksaan dilakukan setelah Notaris diberi kesempatan untuk memperbaiki kesalahan. DKD Kulon Progo melakukan pembinaan dan pemeriksaan dengan berkoordinasi bersama alat perlengkapan lain dan Pemerintah, dan pemeriksaan dilakukan atas dasar laporan yang diterima beserta bukti-bukti serta dilaksanakan dengan menerapkan prinsip kekeluargaan. Keempat, MPD Bantul melakukan pengawasan dan pembinaan ketika melakukan pemeriksaan protokol Notaris, pemeriksaan dilakukan sesuai dengan mekanisme peraturan perundang-undangan. DKD Bantul melakukan pembinaan dan pengawasan secara fleksibel, setiap ada kesempatan, pemeriksaan dilakukan jika ada laporan tertulis, jika terbukti melanggar, Notaris akan diberi sanksi sesuai kualitas dan kuantitas pelanggaran.

Notary cooperation with KSPPS BMT Beringharjo is suspected of having the potential to violate the Notary Code of Ethics. Based on the documents provided by the Notary as an administrative requirement, there is a cover letter whose contents are the same as a letter of request for cooperation. Based on this, the author is interested in conducting this research. The purpose of this research is to explain the cooperation background between a notary and KSPPS BMT Beringharjo, describe and analyze the work practice in terms of the Notary Code of Ethics, explain the role of the MPD, and explain the part of DKD in terms of enforcing the Notary Code of Ethics. This research is empirical juridical with primary data obtained from the field by interviewing research subjects and secondary data obtained from literature studies. The research subjects involved were 9 (nine) respondents and 3 (three) sources. This research is descriptive in nature and uses qualitative data analysis methods. The results of this study are, first, the cooperation between KSPPS BMT Beringharjo and a Notary was motivated by the need of KSPPS BMT Beringharjo for security in providing financial services and the function of the position attached to the Notary. Second, the cover letter can equate to a letter of request for cooperation, so submitting a cover letter could potentially violate the notary code of ethics. Third, the Kulon Progo MPD conducts supervision and guidance at any time, especially during the inspection of the Notary protocol. The inspection is carried out after the Notary is given the opportunity to correct their negligence. The Kulon Progo DKD conducts guidance and inspections in coordination with the Government and other parties, and inspections are carried out based on reports received along with evidence. They will be carried out by applying the principle of kinship. Fourth, the Bantul MPD conducts supervision and guidance when examining the Notary protocol. The inspection is carried out following the mechanism regulated in the law. The Bantul DKD provides flexible guidance and supervision. Whenever there is an opportunity, an inspection is carried out if there is a written report. Suppose the code of ethics is proven to be violated. In that case, the Notary will be sanctioned according to the quality and quantity of the violation.
