REFORMULASI PEMANFAATAN HUTAN DALAM RANGKA MEWUJUDKAN KEBIJAKAN KEHUTANAN YANG BERKELANJUTAN BERWAWASAN LINGKUNGAN (Studi atas Izin Usaha Pemanfaatan Hasil Hutan Kayu (IUPHHK) Di Provinsi Riau)

Isu utama dalam tulisan ini adalah buruknya sistem pemanfaatan hutan terutama Izin Usaha Pemanfaatan Hasil Hutan Kayu dan hal tersebut mempengaruhi sistem pengelolaan hutan berkelanjutan yang berwawasan lingkungan. Terdapat 3 (tiga) permasalahan yang dikaji yakni, pertama, pengaturan pemanfaatan hutan berdasarkan peraturan perundang-undangan yang berlaku dan kesesuaiannya dengan tujuan pembangunan hutan berkelanjutan yang berwawasan lingkungan. Kedua, Implementasi perizinan pemanfaatan hasil hutan kayu (IUPHHK) di Provinsi Riau berdasarkan Peraturan Perundang-Undangan dan kesesuaiannya dengan tujuan pembangunan hutan berkelanjutan yang berwawasan lingkungan. Ketiga, Reformulasi pemanfaatan hutan dalam rangka mewujudkan kebijakan kehutanan yang berkelanjutan berwawasan lingkungan. Penelitian ini merupakan penelitian hukum yuridis normatif dengan pendekatan perundang-undangan dan konseptual. Data yang digunakan adalah data sekunder berupa beberapa peraturan perundang-undangan terkait. Penulis juga menggunakan hasil-hasil penelitian jurnal, makalah sebagai bahan hukum sekunder. Kamus Besar Bahasa Indonesia, kamus hukum sebagai bahan hukum tersier. Hasil penelitian menunjukkan: (1) terdapat beberapa peraturan yang berkaitan dengan pemanfaatan hutan yang tidak mengakomodir pemanfaatan hutan secara berkelanjutan dan beberapa peraturan yang tidak berkesesuaian dengan tujuan pembangunan hutan berkelanjutan yang berwawasan lingkungan baik dari faktor pembangunan sosial, faktor pembangunan ekonomi, faktor pembangunan ekologi dan faktor tata kelola dan hukum; (2) Penerbitan Izin pemanfaatan Hasil Hutan Kayu (IUPHHK) di Provinsi Riau mengalami banyak permasalahan baik dari tingginya angka deforestasi, tata Kelola hutan yang buruk maupun lembaga yang berkaitan dengan penerbitan izin tersebut. Terdapat ketidaksesuaian perizinan pemanfaatan hasil hutan kayu (IUPHHK) di Provinsi Riau dengan tujuan pembangunan hutan berkelanjutan yang berwawasan lingkungan, baik dari faktor pembangunan sosial, faktor pembangunan ekonomi, faktor pembangunan ekologi dan faktor tata kelola dan hukum; dan (3) Reformulasi pemanfaatan hutan dalam rangka mewujudkan kebijakan kehutanan berkelanjutan berwawasan lingkungan yang ideal harus menempatkan masyarakat sebagai subjek pengelola dan pemanfaatan hutan, melalui : (a) Penguatan Desentralisasi Pengelolaan dan Pemanfaatan Hutan; dan (b) Penguatan partisipasi masyarakat dalam pengelolaan dan pemanfaatan hutan mulai dari proses perencanaan, pelaksanaan hingga pengawasan pemanfaatan hutan berkelanjutan.

The fundamental concern in this study is the ineffective forest utilization system, particularly the Business Permit for the Utilization of Timber Forest Products, which has an impact on a sustainable and environmentally sound forest management system. The study focuses on three (3) issues: first, the regulation of forest usage based on existing laws and regulations, as well as their compliance with the goals of sustainable forest development from an environmental standpoint. Second, the implementation of Business Permit for Forest Timber Utilization in Riau Province is based on statutory regulations and their conformity with the objectives of sustainable forest development that are environmentally sound. Third, reformulation of forest use in order to realize sustainable forestry policies with an environmental perspective. This study is normative juridical law with a statutory and conceptual approach. Secondary data in the form of many related laws and regulations were used in this study. As secondary legal materials, the writer also employed the findings of journals articles. As tertiary legal material, used the Great Indonesian Dictionary and the legal dictionary. The results showed: (1) there are several regulations relating to forest use that do not accommodate sustainable forest use and several regulations that are not in accordance with the objectives of sustainable forest development that are environmentally sound, both from social development, economic development, ecological development, and governance and legal factors; (2) Many issues arose during the issuance of Business Permit for Forest Timber Utilization in Riau Province, owing to the high rate of deforestation, poor forest governance, and institutions involved in the issuance of these permits. There is a discrepancy in the Business Permit for Forest Timber Utilization in Riau Province with the aim of developing sustainable forests that are environmentally sound, both from social development factors, economic development factors, ecological development factors and governance and legal factors; and (3) Reformulating forest use in the context of achieving an ideal environmentally sustainable forestry policy must prioritize the community as the subject of forest management and utilization, through: (a) Strengthening Forest Management and Utilization Decentralization; and (b) Increasing community participation in forest management and utilization, beginning with the planning, implementation, and monitoring processes for sustainable forest use.
