Artikulasi Asas Tanggung Jawab Negara Terhadap Perlindungan Kawasan Hutan Oleh Balai Besar Taman Nasional Bromo Tengger Semeru

Negara sebagai penanggung jawab atas jaminan lingkungan hidup yang baik dan sehat sekaligus menjadi wujud dari artikulasi asas tanggung jawab negara yang tercantum dalam Pasal 2 huruf a harusnya mengambil peran penting dalam menjaga kelestarian lingkungan. Hal itulah yang menjadi dasar peneliti tertarik untuk melakukan penelitian guna menjawab 2 rumusan masalah yaitu, 1.) Bagaimana artikulasi asas tanggung jawab negara dalam upaya perlindungan kawasan konservasi Taman Nasional Bromo Tengger Semeru?; 2.) Bagaimana peran Balai Besar Taman Nasional Bromo Tengger Semeru (BBTNBTS) terkait implementasi asas tanggung jawab negara terhadap perlindungan kawasan konservasi?. Dalam upaya menjawab 2 rumusan masalah tersebut, peneliti menggunakan jenis penelitian hukum normatif fan penelitian hukum empiris dengan mengumpulkan bahan hukum primer, sekunder dan tersier. Berdasarkan hasil penelitian, peneliti berkesimpulan bahwa dijadikannya kawasan pegunungan semeru sebagai Taman Nasional merupakan langkah yang prospektif oleh Negara yang sekaligus menunjukkan artikulasi asas tanggung jawab negara yang telah disebutkan di dalam UUPPLH. Terlebih lagi penetapan suatu instansi yang menjadi lembaga pengelola TNBTS dalam hal ini adalah Balai Besar Taman Nasional Bromo Tengger Semeru (BBTNBTS) yang telah melaksanakan perlindungan hutan selama belasan tahun terakhir. Namun perlindungan kawasan hutan di TNBTS juga terdapat beberapa hambatan yang di alami oleh BBTNBTS dalam menjalankan wewenangnya antara lain, kurangnya personel polisi kehutanan, minimnya sarana dan prasarana serta kesadaran masyarakat yang masih rendah.

The state as the person in charge of guaranteeing a good and healthy environment as well as being a manifestation of the articulation of the principle of state responsibility as stated in Article 2 letter a should take an important role in preserving the environment. This is the reason why researchers are interested in conducting research to answer 2 problem formulations, namely, 1.) How is the articulation of the principle of state responsibility in protecting the conservation area of Bromo Tengger Semeru National Park?; 2.) What is the role of the Bromo Tengger Semeru National Park Center (BBTNBTS) regarding the implementation of the principle of state responsibility for the protection of conservation areas? In an effort to answer the two problem formulations, the researcher uses normative legal research and empirical legal research by collecting primary, secondary and tertiary legal materials. Based on the results of the study, the researcher concluded that the making of the Semeru mountain area as a National Park is a prospective step by the State which also shows the articulation of the principle of state responsibility as stated in the UUPPLH. Moreover, the establishment of an agency to be the management agency of TNBTS in this case is the Bromo Tengger Semeru National Park Center (BBTNBTS) which has carried out forest protection for the last dozen years. However, the protection of forest areas in TNBTS also has several obstacles experienced by BBTNBTS in carrying out its authority, including the lack of forest police personnel, lack of facilities and infrastructure and low public awareness.
