Penentuan Subyek Pajak Luar Negeri Terhadap Pemajakan Transaksi Ekonomi Digital di Indonesia (Cross Border Transaction) dalam Aspek Kepastian Hukum dan Keadilan

Perkembangan ekonomi digital yang sedemikian cepat memberikan tantangan tersendiri bagi otoritas pajak disetiap negara untuk menjaga hilangnya potensi penerimaan negara di sektor perpajakan. Salah satu isu penting yang muncul adalah bagaimana mengalokasikan hak pemajakan terhadap penghasilan yang diterima Subjek Pajak Luar Negeri (SPLN) atas penghasilan yang diterima dari negara sumber. Topik ini juga menjadi perhatian dan bahan diskursus oleh Organisation for Economic Coo-peration and Development (OECD), G20 dan United Nations tekait isu pemajakan terhadap transaksi ekonomi digital. Berdasarkan Pasal 7 ayat (1) P3B Model OECD bahwa laba usaha yang diperoleh suatu SPLN di negara sumber, hanya akan dikenakan pajak di negara sumber apabila SPLN tersebut menjalankan usaha melalui suatu Bentuk Usaha Tetap (BUT). Rezim perpajakan internasional yang berlaku saat ini masih menggunakan pendekatan physical presence dalam menentukan BUT di suatu negara. Seiring perkembangan digitalisasi ekonomi, hal ini menjadi tidak relevan karena SPLN tidak memerlukan adanya physical presence untuk melakukan transaksi ekonomi digital di suatu negara. SPLN dapat melakukan transaksi jarak jauh dengan skala ekonomi yang besar secara global tanpa memerlukan kehadiran secara fisik di negara pasar (consumer markets). Kondisi tersebut menimbulkan ketidakadilan bagi negara sumber yang memiliki potensi pasar digital yang demikian besar seperti di Indonesia. Melihat adanya ketidakpastian terkait pemajakan terhadap transaksi ekonomi digital, beberapa negara mengambil kebijakan perpajakan secara unilateral, seperti di Australia, Inggris dan India. Melalui penerbitan UU Nomor 2 tahun 2020, Indonesia telah menerapkan kebijakan unilateral berupa penetapan BUT melalui economic presence test dan pengenaan Pajak Transaksi Elektronik. Indonesia merupakan negara hukum sebagaimana yang dinyatakan dalam Undang-Undang Dasar Negara Republik Indonesia Tahun 1945. Hukum yang baik adalah hukum yang responsif terhadap dinamika yang berkembang di masyarakat. Rezim perpajakan internasional saat ini tidak menghadirkan prinsip keadilan dalam mengalokasikan hak pemajakan terhadap laba usaha yang diterima SPLN dalam kasus tidak terdapat BUT. Dengan demikian, pemerintah Indonesia perlu meningkatkan hubungan kerjasama dengan negara lain untuk mendorong adanya reformasi sistem perpajakan internasional yang berlaku saat ini, dengan tujuan agar masing-masing yurisdiksi mendapatkan alokasi hak pemajakan secara adil dan objektif terhadap pemajakan transaksi ekonomi digital yang berlandaskan pada kedaulatan pajak di masing-masing negara.

The rapid development of the digital economy presents its own challenges for tax authorities in each country to avoid the loss of potential state revenue in the taxation sector. One important issue that arises is how to allocate taxation rights to the income received by the Non-resident Tax Payer (SPLN) on the income received from the source country. This topic is also of concern and discourse material by the Organization for Economic Co-operation and Development (OECD), G20 and the United Nations regarding the issue of taxation on digital economic transactions. Based on Article 7 paragraph (1) of the OECD Model, the business profit obtained by an SPLN in the source country will only be taxed in the source country if the SPLN operates a business through a Permanent Establishment (PE). The current international tax regime still uses the physical presence approach in determining PE in the country. Along with the development of economic digitization, this has become irrelevant because SPLN does not require a physical presence to conduct digital economic transactions in the country. SPLN can operates cross border transactions with large economies of scale globally without requiring a physical presence in market countries. This condition creates unfair for source countries that have such huge digital market potential, such as in Indonesia. Seeing the uncertainty regarding taxation of digital economic transactions, several governments have proposed or introduced unilateral tax measures, such as in Australia, United Kingdom and India. Through the issuance of Law of the Republic of Indonesia Number 2 of 2020, Indonesia has implemented the unilateral tax measures in the form of establishing PE through an economic presence test and imposition of the Electronic Transaction Tax. Indonesia is a constitutional state as stated in the 1945 Constitution of the Republic of Indonesia. Good law is a law that is responsive to the dynamics that develop in society. The current international tax regime regarding the taxation of business profits is unfair in allocating taxing rights in those cases where there is no PE. Thus, the Indonesian government needs to improve cooperative relations with other countries to encourage reforms of the current international taxation system, with the aim that each jurisdiction can obtain a fair and objective allocation of taxation rights to digital economic transactions based on tax sovereignty in each country.
