Penelitian hukum ini dimuat untuk melihat dampak diberlakukannya Peraturan Daerah Provinsi Jawa Timur Nomor 1 Tahun 2018 Tentang Rencana Zonasi Wilayah Pesisir dan Pulau-Pulau Kecil Provinsi Jawa Timur Tahun 2018- 2038 atau disebut sebagai Perda RZWP3K Jatim Terhadap Pelaku Usaha Eksisting di Kabupaten Lamongan dari segi kepastian hukum. Bahwa dengan terbitnya Perda RZWP3K diharapkan mampu memberikan kepastian hukum terhadap penggunaan ruang khususnya ruang di wilayah pesisir dan pulau-pulau kecil, namun dengan terbitnya Perda RZWP3K menimbulkan ketidakpastian hukum terhadap pelaku usaha eksisting yang dalam penelitian ini yakni PT Prakitri Hasta Darma dan PT Lintech Duta Pratama. Bahwa metode penelitian yang digunakan oleh penulis yakni penelitian normatif-empiris yang didasarkan pada data sekunder yang dilengkapi dengan wawancara. Data yang diperoleh oleh penulis kemudian dianalisis menggunakan metode kualitatif yang disajikan secara deskriptif analitis. Dari hasil penelitian ini diketahui bahwa terdapat pasal-pasal dalam Perda RZWP3K yang dapat mempengaruhi kepastian hukum bagi pelaku usaha eksisiting yakni adanya zonasi yang masuk ke dalam kawasan industri tapi tidak dapat digunakan untuk kegiatan industri dikarenakan khawatir terjadi pencemaran lingkungan, adanya pembatasan reklamasi dan dapat ditinjaunya peraturan dalam kurun waktu 5 tahun sekali yang menyebabkan aturan mudah berubah-ubah.

This legal research conducted to observe the impact of the enactment of East Java Provincial Regulation Number 1 of 2018 on Zoning Plans for Coastal Areas and Small Islands of East Java Province in 2018-2038 or referred to as East Java RZWP3K Regulations to Existing Business in Lamongan District in terms of legal certainty. Whereas, by the issuance of RZWP3K is expected to be able to provide legal certainty in relation to the use of space, especially space in coastal areas and small islands, therefore with the issuance of RZWP3K raises legal uncertainty for existing business as follow PT Prakitri Hasta Darma and PT Lintech Duta Pratama. Whereas, the research method used by the author is normative-empirical research based on secondary data supplemented by interviews. The author analyzed using qualitative methods which are presented descriptively analytically after obtaining the data. From the results of this research, founded that there are articles stipulated in RZWP3K that may affect to the legal certainty for existing business activity such as the existence of zonation which is included to the industrial zonation therefore not be able to use for industrial activities due to the opinion that it might polluted the environment, there are restriction on reclamation and also this regulation may be reviewed within period of 5 years which causes the regulation often to change.
