Implikasi Hukum Berakhirnya Commercial Operation Date (COD) Terhadap Kedudukan Kontrak dan Tanggung Jawab Kontraktor Dalam Penyelesaian Kontrak Engineering, Procurement, Construction (EPC) Pada Pembangunan Pembangkit Listrik Di PT PLN (Persero)

Tujuan yang diharapkan oleh penulis dalam penelitian ini adalah untuk mengetahui kedudukan kontrak dan tanggung jawab kontraktor dalam penyelesaian kontrak engineering, procurement, constrcution (EPC) pembangunan pembangkit listrik di PT PLN (Persero) setelah berakhirnya Commercial Operation Date (COD). Penelitian ini merupakan penelitian yang bersifat normatif empiris, karena penelitian ini dilakukan dengan cara mengkaji dan mendeskripsikan bahan-bahan pustaka, yang berupa literatur, perundang-undangan dan dikaitkan dengan hasil wawancara nara sumber dan responden yang memiliki kaitan dengan permasalahan yang akan dibahas. Metode analisis data yang digunakan dalam penelitian ini adalah analisis kualitatif, yaitu uraian data secara bermutu dalam bentuk kalimat yang teratur, runtun, logis dan tidak tumpang tindih sehingga memudahkan implementasi data dan pemahaman hasil analisis. Hasil penelitian menunjukan bahwa setelah berakhirnya Commercial Operation Date yang ditentukan dalam Kontrak EPC pembangunan pembangkit listrik, dinyatakan bahwa Kedudukan Kontrak masih berlaku dan belum berakhir serta masih mengikat para pihak hingga penyelesaian kontrak dilakukan, yakni setelah dilaksanakannya Serah Terima Akhir (Final Acceptance Certificate). Berakhirnya waktu Commercial Operation tidak menghilangkan tanggung jawab kontraktor untuk tetap menyelesaikan kontrak EPC Pembangunan PLTU yang telah disepakati sebelumnya. Kontraktor wajib menyelesaikan pekerjaan dengan segala risiko yang menjadi beban tanggung jawab kontraktor sesuai kontrak. Untuk mengatasi permasalahan yang ada, harus dilakukan penyempurnaan kontrak yakni menentukan waktu Taking Over Certificate secara kuantitatif dan ditetapkan sebagai batas waktu penyerahan pekerjaan di dalam kontrak EPC Pembangunan Pembangkit Listrik.

The expected purpose of the writer in this research is to know the state of contract and the liabilities of a contractor in the completion of a contract of Engineering, Procurement, and Construction (EPC) on the construction of a power plant in PT PLN (Persero) after the expiration of the Commercial Operation Date (COD). This research is an empirical normative research, because it was conducted by reviewing and describing library materials, in the form of literature, legislation and being associated with the results of the interviews with the interviewees and the respondents who dealt with the issues to be discussed. The method of data analysis which is used in this research is qualitative analysis, namely the certifiable description of the data in the form of regular, coherent, logical and non-overlapping sentences so as to facilitate the implementation of the data and the comprehension of the analysis results. The results of the research show that after the expiration of the Commercial Operation Date specified in the EPC Contract of the construction of power plants, it was stated that the Contract State was still valid and did not expire and still bound the parties until the completion of the contract conducted, which was after the Final Acceptance Certificate. The expiration of the Commercial Operation time did not eliminate the liabilities of the contractors that was to continue completing the EPC contract of the construction of PLTU which had been previously agreed. The contractors were obliged to complete the work with all risks which became the contractor's liabilities under the contract. To overcome the existing problems, contract improvements must be made, that is to determine the time of Taking Over Certificate quantitatively and set it as the deadline for the submission of the work in the EPC contract of the construction of the power plants.
