KONSEP KEADILAN RESTORATIF DALAM PERSPEKTIF FILSAFAT PANCASILA NOTONAGORO

Penelitian ini mengkaji persoalan keadilan yang menjadi perhatian serius di masyarakat. Proses hukum di lingkungan peradilan hingga saat ini dianggap belum sepenuhnya mencerminkan nilai-nilai keadilan sehingga menimbulkan kekecewaan dan ketidakpuasan. Keadilan menjadi sesuatu yang jauh dari jangkauan masyarakat sehingga perlu adanya sistem peradilan yang memenuhi rasa keadilan bagi semua pihak. Secara garis besar penelitian ini mengkaji konsep keadilan restoratif dan apa analisis filsafat Pancasila Notonagoro dalam konsep keadilan restoratif. Penelitian ini adalah penelitian tentang permasalahan-permasalahan aktual terkait keadilan dan Filsafat Pancasila. Peneliti berusaha menganalisis peranan Filsafat Pancasila sebagai Genetivus Subjectivus dengan konsep Keadilan Restoratif. Tahapan penelitian ini meliputi pengumpulan data, klarifikasi data yang diperoleh, menganalisis data, dan menuangkan analisis dalam bentuk evaluasi kritis. Analisis data yang ada menggunakan unsur-unsur metodis: deskripsi, interpretasi, holistika, dan heuristika. Hasil dalam penelitian ini adalah: Pertama, Keadilan Restoratif merupakan Keadilan yang dilandasi perdamaian antara pelaku, korban dan masyarakat. Hal tersebut merupakan moral etik dari Keadilan Restoratif, oleh karena itu keadilannya dikatakan sebagai "Just Peace Principle". Prinsip ini mengingatkan bahwa keadilan dan perdamaian pada dasarnya tidak dapat dipisahkan. Perdamaian tanpa keadilan adalah penindasan, keadilan tanpa perdamaian adalah bentuk baru penganiayaan/ tekanan. Dikatakan sebagai Just Peace Principle atau Just Peace Ethics karena pendekatan terhadap kejahatan dalam Keadilan Restoratif bertujuan untuk pemulihan kerusakan akibat kejahatan (it is an attempt to recovery justice), upaya ini dilakukan dengan mempertemukan korban, pelaku dan masyarakat. Kedua, Dalam perspektif filsafat Pancasila, konsep keadilan restoratif ini sesuai dengan nilai-nilai Pancasila. Pancasila secara filosofis sebagai sumber dari segala hukum di Indonesia memberikan ruang agar konsep Keadilan Restoratif ini dapat diterapakan dengan tidak melanggar aturan-aturan hukum yang telah ada.

This research examines the issue of justice that is of serious concern in the community. The legal process in the judiciary to date has not been fully reflected in the values of justice, resulting in disappointment and discontent. Justice seems to be far from the reach of society so that the need for a justice system that meets the sense of justice for all parties. In general, this study examines the concept of restorative justice and what is the analysis of Pancasila Notonagoro's philosophy in the concept of restorative justice. This research on actual issues related to justice and Philosophy of Pancasila. Researchers attempted to analyze the role of Pancasila Philosophy as Subjectivus Genetivus with the concept of Restorative Justice. Stages of this study include data collection, clarification of data obtained, analyzing data, and pouring analysis in the form of critical evaluation. Analysis of existing data using methodical elements: description, interpretation, holistic, and heuristic. The results of this research are: First, Restorative Justice is a peace-based Justice between the perpetrator, the victim and the community. It is the ethical morality of Restorative Justice, therefore its justice is said to be "Just Peace Principle". This principle reminds us that justice and peace are essentially inseparable. Peace without justice is oppression, justice without peace is a new form of persecution / pressure. It is said to be Just Peace Principle or Just Peace Ethics because the approach to crime in Restorative Justice aims to restore the damage caused by the crime (it is an attempt to recovery justice), this effort is done by bringing together victims, perpetrators and the community. Second, In the perspective of Pancasila philosophy, this concept of restorative justice is in accordance with the values of Pancasila. Pancasila philosophically as the source of all laws in Indonesia gives space for the concept of Restorative Justice can be applied by not violating existing rules of law.
