KESESUAIAN PELAKSANAAN PEMBERIAN IZIN PENDIRIAN PABRIK INDUSTRI FARMASI BAGI PERUSAHAAN PENANAMAN MODAL ASING DI KAWASAN INDUSTRI LIPPO CIKARANG KABUPATEN BEKASI

Penelitian ini dilakukan untuk mengidentifikasi dan menilai kesesuaian pelaksanaan pemberian Izin Pendirian Pabrik Industri Farmasi yang sesuai dengan ketentuan yang berlaku dan kendala serta solusi apa yang muncul dalam pemberian izin. Penelitian ini dilakukan dengan menggunakan metode penelitian hukum normatif-empiris (hukum penelitian terapan). Penulis telah melakukan penelitian dengan menilai penerapan hukum tertulis positif pada kasus hukum dalam pemberian izin dari Industri Farmasi untuk Perusahaan Penanaman Modal Asing. Pemberian izin pendirian pabrik di industri farmasi mulai dengan izin prinsip yang dikeluarkan oleh Direktorat Jenderal Bina Kefarmasian dan Alat Kesehatan Kementerian Kesehatan Republik Indonesia. Menurut Pasal 6 Peraturan Menteri Kesehatan Republik Indonesia Nomor 1799 / Menkes / Per / XII / 2010 tentang Industri Farmasi, jika persetujuan prinsip telah diberikan pemohon, dapat segera melakukan persiapan, pembangunan, pengadaan, pemasangan dan instalasi peralatan, termasuk produksi percobaan. Oleh karena itu Persetujuan Prinsip adalah salah satu hal yang penting untuk mengizinkan pendirian pabrik farmasi. Pemerintah selaku lembaga legislatif telah membuat dan merumuskan peraturan dalam pemberian izin khususnya untuk pendirian pabrik industri farmasi sebagai panduan bagi pemberi izin maupun pemohon izin. Ada ketidaksesuaian dalam pemberian izin seperti lamanya waktu penerbitan izin. Ketidaksesuaian itu disebabkan oleh kendala yang diantaranya adalah kurangnya sumber daya manusia yang berwenang dalam mengolah perizinan yang dimohonkan dan tidak mencantumkan kekhususan yang harus dipenuhi oleh investor asing untuk memperoleh izin.

This research was conducted with the objective to identify and assess compatibility of Factory Establishment Permit Granting the implementation of the Pharmaceutical Industry For Foreign Investment Company with prevail regulation, and to identify and assess obstacles and any solution that who appeared in the provision of licenses. This research was conducted by using normative-empirical legal research method (applied research law). The author has conducted research by assessing the application of positive written law on legal cases in the granting of licenses from the Pharmaceutical Industry to Foreign Investment Companies. The licensing of factory establishment in the pharmaceutical industry starts with the principle license issued by the Directorate General of Pharmaceutical and Medical Equipment of the Ministry of Health of the Republic of Indonesia. According to Article 6 of Regulation of the Minister of Health of the Republic of Indonesia No. 1799 / Menkes / Per / XII / 2010 concerning the Pharmaceutical Industry, if the principle approval has been granted the applicant, may immediately undertake the preparation, development, procurement, installation and installation of equipment, including trial production. Therefore Principle Approval is one of the important things to allow the establishment of a pharmaceutical factory. The Government as a legislative body has established and formulated regulations in the granting of licenses, especially for the establishment of pharmaceutical manufacturing factories as a guide for the licensor and applicant permit. There is a discrepancy in the granting of licenses such as the length of time of issue of permit. The inadequacy is caused by obstacles such as lack of human resources authorized in processing the requested permits and does not include the specificity that must be met by foreign investors to obtain permits.
