Independensi Lembaga Negara Independen (Studi Dalam Konsep Independent Regulatory Agencies)

Penelitian ini bertujuan untuk mengetahui, menganalisis, menelaah, memahami dan menjelaskan mengenai sejauh mana Independensi Lembaga negara Independen (LNI) yang ada di Indonesia dengan menggunakan konsep Independent Regulatory Agencies (IRAs) sebagai indikatornya. Di samping itu juga merupakan upaya untuk menggagas format independensi yang ideal bagi LNI dalam konteks Indonesia. Metode yang digunakan dalam penelitian hukum ini adalah penelitian hukum normatif, yang dilakukan melalui studi pustaka atau data sekunder. Data terdiri dari bahan hukum primer, sekunder dan tersier, yang kemudian diolah secara deskriptif-preskriptif. Penelitian ini juga menggunakan beberapa pendekatan seperti pendekatan undang-undang, konseptual, dan pendekatan kasus. Sebagai respon dari ketidakpercayaan masyarakat terhadap pemerintah dan buruknya kinerja lembaga negara yang ada, maka muncul ide untuk membentuk lembaga negara yang diidealkan memiliki karakteristik independen. Berdasarkan kebutuhan masyarakat, jumlah lembaga negara independen (LNI) di Indonesia relatif meningkat jumlahnya sejak amandemen UUD 1945. Sayangnya, kebutuhan akan lembaga yang bebas dari campur tangan pemerintah tidak dibarengi dengan perumusan standar kriteria dan desain kelembagaan yang matang, salah satunya pada aspek independensi yang menjadi ciri utama LNI. Berdasarkan kajian menggunakan indikator dalam konsep IRAs, independensi LNI di Indonesia cenderung tidak seragam satu sama lain. Beberapa lembaga telah memenuhi indikator independensi formal dalam konsep IRAs, namun sebagian lain masih memiliki aspek pengaturan yang belum lengkap. Hasil kajian terhadap independensi de facto juga menunjukkan adanya intervensi, politisasi dan resistensi dari berbagai pihak terhadap kehadiran dan kebijakan LNI di Indonesia. Berkaca pada hal ini, penulis menawarkan beberapa konsep guna merumuskan format independensi yang ideal bagi LNI dalam konteks Indonesia.

This study aims to identify, analyze, examine, understand and explain the extent to which the independence of the Independent states Institutions (LNI) in Indonesia by using the concept of Independent Regulatory Agencies (IRAs) as an indicator. In addition, it is also an attempt to initiate an ideal Independence format for the LNI in the context of Indonesia. The method used in this study is a normative legal research, conducted through literature or secondary data. The data consists of primary legal materials, secondary and tertiary, which are then processed as descriptive-prescriptive. This study also uses several approaches like statute approach, conceptual, and case approach. In response to public distrust of the government and the poor performance of existing state institutions, then came the idea to establish an idealized state Institution which should have certain independent characteristics. Based on the needs of the community, the number of independent state institutions (LNI) in Indonesia is relatively increased since the amendment of the UUD 1945. Unfortunately, the need for institutions which are free from government interference is not well accompanied by the sufficient formulation of standards and institutional design, one of them is the independence aspects which is the main feature of LNI. Based on studies using indicators in the concept of IRAs, the independence of the LNI in Indonesia tend to be diverge with one another. Some agencies have met the indicator of formal independence in the concept of IRAs, but others still have an incomplete regulation aspects. The results of the study on de facto independence also shows the intervention, politicization and resistance from various parties regarding the presence and policy of LNI in Indonesia. Reflecting on this, the author offers some concepts to formulate the ideal independence format for the LNI in the context of Indonesia.
