PELANGGARAN CINA TERHADAP PERJANJIAN TRIPS DALAM WTO ATAS PRODUK AMERIKA SERIKAT

Peran Cina dalam sistem politik ekonomi global tidak bisa dipungkiri. Akhir-akhir ini, Cina memiliki posisi tawar yang penting untuk mempengaruhi situasi yang dinamis dalam sistem ekonomi-politik dunia. Salah satu kasus nyata yang terjadi adalah pengaruh Cina dalam sistem ekonomi adalah keanggotaan Cina dalam Organisasi Perdagangan Dunia. Tetapi tindakan negara Cina ini tidak dapat digolongkan sebagai contoh yang baik bagi negara lain karena Cina telah melanggar salah satu aturan ketat yang telah diselenggarakan oleh WTO sejak pertama kali berdirinya organisasi ini. Tindakan Cina telah melanggar aturan WTO dalam undang-undang hak kekayaan intelektual yang membatasi anggotanya untuk tidak membuat produk bajakan, terutama produk yang meniru hasil karya dari kekayaan intelektual negara lain, termasuk ponsel, barang elektronik dan kendaraan. Tindakan Cina benar-benar memberikan iklim yang tidak adil bagi negara lain, yang dalam hal ini adalah Amerika Serikat. Tapi, strategi kerjasama Cina dengan tipe soft-power membuat kasus ini tidak dianggap sebagai pelanggaran serius bagi Cina, karena Cina masih saja tetap memproduksi barang elektronik dan produk-produk Amerika Serikat dengan harga rendah untuk dijual ke pasar global. Dalam kehidupan nyata, kita kemudian melihat fenomena pasar, bahwa Cina sebagai produsen di pasar global menyebabkan kualitas produk buatan Cina menjadi rendah ketika dibandingkan dengan produk asli buatan Amerika Serikat.

China's role in global economic political system can't be denied. Lately, China has an important bargaining position to influence the dynamic situation in the world political-economic system. One real case that occurred is the Chinese influence in the economic system is the membership of China in the World Trade Organization. But the Chinese state's actions can't be classed as a good example for other countries, because China has violated one of the strict rules that have been organized by the WTO since the first time the establishment of this organization. China's action has violated WTO rules in the legislation of intellectual property rights that restrict members to not make pirated products, especially products that mimic the work of the intellectual property of other countries, including phones cell, electronic goods and vehicles. Chinese action actually providing a climate that is not fair for other countries, which is in this case is United States. However, China's cooperation strategy with the type of soft-power makes this case is not regarded as a serious offense by China, because China still keep producing electronic goods and other products from USA with low prices to sale in global markets. In real life, we then look at the phenomenon of the market, that China as a manufacturer in the global market led to the quality of products made in from China to be low when it compared to the genuine products made in by United States.
