TELEDENTISTRY : KAJIANASPEK HUKUM DAN POTENSI IMPLEMENTASINYA BAGI RUMAH SAKIT

Latar belakang:Teledentistry adalah penggunaan tekhnologi informasi untuk melaksanakan kedokteran gigi tanpa batasan jarak. Teledentistry telah banyak diterapkan di rumah sakit luar negeri karena dapat meningkatkan pelayanan kesehatan. Disamping manfaatnya yang begitu besar, Teledentistry juga mempunyai isu hukumantara lain pemberian lisensi, privasi dan kerahasiaan catatan medis elektronik pasien, pedoman klinis, dan lain-lain. Permasalahannya adalah bagaimana potensi Teledentistry bagi rumah sakit dan bagaimana mengkaji aspek hukum Teledentistry . Tujuan: Penelitian ini membahas tentang potensi Teledentistry bagi rumah sakitdan mengkaji aspek hukumnya. Metode: Penelitian ini dilakukan dengan metode mereview kasus dari luar negeri dan mewawancarai para dokter gigi spesialis serta ahli hukum. Hasil Penelitian: Dari wawancara dengan beberapa dokter gigi spesialis terdiri dari 7 orang yang merupakan perwakilan dari tiap bidang spesialisasi ditambah seorang ahli hukum yang bekerja dirumah sakit serta case review, menunjukkan bahwa potensi implementasi Teledentistry adalah untuk promotif, preventif, kuratif, rehabilitatif dan berkembang untuk sub spesialisasinya. Sebagai konsekuensi implementasi maka penyiapan regulasi sangat dibutuhkan. Kesimpulan: Potensi Implementasi Teledentistry bagi rumah sakit (khususnya Indonesia) adalah bisa dan memungkinkan. Implementasi Teledentistry memperhatikan tanggung jawab petugas kesehatan, hak pasien dan kerahasiaan medik. Selain itu Informed Consent sangat diperlukan untuk mencegah sengketa atau hal-hal yang tidak dinginkan terkait Teledentistry.

Background: Teledentistry is the use of information technology to implement dentistry without distance limitations. Teledentistry has been widely applied in hospitals abroad because it can improve health service. Besides the benefits which are so great, Teledentistry also has several legal issues such as licensing, privacy and confidentiality of electronic patient medical records, clinical guidelines, and others. The problem is how Teledentistry potential implementation in hospital and how to research the legal aspectof Teledentistry. Objective: This study discusses about Teledentistry potential and legal aspects of its implementati on for hospital. Methods: This research was conducted by reviewing cases from overseas and interview in dentists specialists and law expert. Research Results: From the interviews with several dentists specialists consisting of 7 persons who are representative of each area of specialization plus one person who are expert of law plus case review, it has been indicate that Teledentistry potential implementation arepreventive, promotive, curative, rehabilitative and developing in specialist. The consequences that the preparation of the regulations is needed to implement Teledentistry. Conclusion: Teledentistrys potential implementationfor hospital (especially in Indonesia) is able and possible. Rules of Teledentistry implementation are related to the responsibility of health personnel, patients rights and medical confidentiality. Informed consent is necessary to prevent unpredictable things related to Teledentistry.
