IMPLEMENTASI PASAL 9 AYAT (2) UNDANG-UNDANG NOMOR 28 TAHUN 2014 TENTANG HAK CIPTA TERKAIT DENGAN PENYEWAAN KARYA SINEMATOGRAFI DALAM BENTUK VCD/DVD PADA USAHA PENYEWAAN VCD/DVD DI PURWOKERTO

Skripsi ini membahas mengenai pelaksanaan atau implementasi pasal 9 ayat (2) Undang-Undang No. 28 Tahun 2014 tentang Hak Cipta mengenai pemanfaatan hak ekonomi yang harus disertai dengan izin dari Pencipta atau Pemegang Hak Cipta. Pemanfaatan hak ekonomi yang dibahas terkait dengan penyewaan karya sinematografi dalam bentuk vcd/dvd pada usaha penyewaan vcd/dvd di Purwokerto adalah penyewaan ciptaan. Penelitian yang dilakukan bersifat yuridis empiris yaitu dilakukan untuk mengetahui sejauh mana efektifitas hukum, dimana kajian penelitian ini meliputi pengetahuan masyarakat, kesadaran masyarakat, dan penerapan hukum dalam masyarakat. Memakai analisa deskriptif kualitatif yaitu memaparkan danmenggambarkan realita atas permasalahan yang ada di lapangan untuk menunjang hasil penelitian. Hasil penelitian menunjukkan bahwa pelaksanaan atau implementasi pasal 9 ayat (2) Undang-Undang No. 28 Tahun 2014 tentang Hak Cipta terkait dengan penyewaan karya sinematografi dalam bentuk vcd/dvd pada usaha penyewaan vcd/dvd di Purwokerto belum dapat berjalan.Hal tersebut disebabkan karena kurangnya pemahaman masyarakat dan penegak hukum terhadap hak penyewaan, sikap ketidakdukungan masyarakat terhadap aturan mengenai hak penyewaan. Selain itu hambatan yang dialami Pemerintah dalam pelaksanaan pasal 9 ayat (2) Undang-Undang No. 28 Tahun 2014 tentang Hak Ciptaterkait dengan penyewaan karya sinematografi dalam bentuk vcd/dvd adalahbelum adanya Peraturan Pelaksana yang mengatur lebih lanjut mengenai ketentuan Hak Penyewaan dalam Undang-Undang No. 28 Tahun 2014 tentang Hak Cipta serta belum adanya Lembaga Manajemen Kolektif khusus film yang menampung royalti bagi Pencipta maupun Pemegang Hak Cipta karya sinematografi.

This paper discusses the execution or implementation of article 9, paragraph (2) of Act No. 28 Year 2014 on Copyright regarding the utilization of the economic rights that must be accompanied with the permission of the creator or the Copyright holder. The use of the economic rights Related with the rental of cinematographic works in the form of VCD / DVD in the rental business VCD / DVD in Purwokerto is renting out creation. The research conducted is an empirical juridical that conducted to determine the extent the effectiveness of the law, where the research study include public knowledge, public awareness, and application of the law in society. Using a qualitative descriptive analysis that is to describe and illustrate the reality of the problems that exist in the field to support the research. The results showed that the execution or implementation of article 9, paragraph (2) of Law No. 28 Year 2014 regarding Copyright Related with the rental of a cinematographic work in the form of VCD / DVD in the rental business VCD / DVD in Purwokerto has not been implemented yet. This was due to a lack of understanding of the community and law enforcement of the rights of rental, unsupportive public attitudes towards rules regarding rental rights. Furthermore the obstacle experienced by the Governement in the implementation of the Article 9 paragraph (2) of Act No. 28 Year 2014 on Copyright Related with the rental of a cinematographic work in the form of VCD / DVD is the absence of the Implementation Regulations which governing more about Rental Rights provisions in the Act No. 28 Year 2014 on Copyright and the lack of Collective Management Institute especially for movies that holds royalties for the Creator and Copyright Holder cinematographic works.
