Peranan pemerintah daerah dalam upaya perlindungan hak kekayaan intelektual terhadap produk unggulan daerah di Kabupaten Klaten

Penelitian ini bertujuan untuk mengetahui bagaimanakah peranan Pemerintah Daerah dalam upaya perlindungan HKI terhadap produk unggulan daerah di Kabupaten Klaten, mengetahui jenis produk unggulan daerah di Kabupaten Klaten yang mendapatkan perlindungan HKI, dan mengetahui permasalahan yang dihadapi oleh Pemerintah Daerah dalam upaya perlindungan HKI terhadap produk ungulan daerah di Kabupaten Klaten serta solusi apa yang dilakukan. Penelitian tentang Peranan Pemerintah Daerah dalam Upaya Perlindungan Hak Kekayaan Intelektual terhadap Produk Unggulan Daerah di Kabupaten Klaten merupakan penelitian hukum normatif. Data primer yang diperoleh melalui penelitian lapangan didukung data sekunder dari studi kepustakaan selanjutnya dianalisis secara kualitatif. Hasil penelitian menunjukkan bahwa peranan Pemerintah Kabupaten Klaten dalam upaya perlindungan HKI terhadap produk unggulan daerah belum optimal, dikarenakan belum adanya peraturan daerah yang secara eksplisit mengaturnya. Jenis produk unggulan daerah di Kabupaten Klaten yang mendapatkan perlindungan HKI meliputi produk unggulan industri alat pertanian, industri konveksi, industri alat kecantikan, industri kerajinan, serta industri makanan dan minuman. Permasalahan yang dihadapi oleh Pemerintah Daerah Klaten adalah belum adanya peraturan daerah yang mengatur tentang upaya perlindungan HKI terhadap produk unggulan daerah, serta kurangnya kesadaran masyarakat akan arti pentingnya perlindungan HKI. Solusi yang dilakukan adalah membuat kebijakan tentang upaya perlindungan HKI terhadap produk unggulan daerah dan melakukan sosialisasi secara intensif kepada masyarakat akan arti penting perlindungan HKI.

The objectives of this research are knowing how the role of local government in IPR protection of the local exellent product, the variant of the local exellent product covered by IPR protection, and also the problems which are faced by local government and it’s solutions. A research on the role of local government in IPR protection of the local exellent product at Klaten region is a normative juridical research. The primary data is collected through field research, and it is supported by the scondary data from the library research, then it is analyzed qualitatively. The results of the research shows that the role of local government to IPR protection of the local exellent product is not optimal yet, because there is no local regulation to rule it explicitly. The variant of the local exellent product which had the IPR protection includes the farming tool industry, the facial cotton industry, the convection industry, the handicraft industry, and the food and beverage industry. The problems which are had the local government of Klaten are: there is no local regulation to rule it explicitly, and there is no society conciousness about the IPR protection. The solutions are: making local regulation about the IPR protection, and having IPR socialization intensively to the society.
