PERLINDUNGAN INDIKASI GEOGRAFIS SEBAGAI BAGIAN DARI HAK KEKAYAAN INTELEKTUAL BERDASARKAN THE AGREEMENT ON TRADE RELATED ASPECTS OF INTELLECTUAL PROPERTY RIGHTS (TRIPs)

Tujuan penelitian ini untuk menganalisis keanggotaan Indonesia dalam perjanjian TRIPs, untuk menganalisis akibat bagi perlindungan Indikasi Geografis di Indonesia setelah diratifikasinya perjanjian TRIPs, serta untuk menganalisis manfaat meratifikasi perjanjian TRIPs bagi perlindungan Indikasi Geografis di Indonesia. Metode penelitian dalam tesis ini bersifat deskriptif analitis. Jenis penelitian adalah yuridis normatif dimana bahan hukum dan hasil penelitian dianalisis secara kualitatif dan untuk selanjutnya disajikan dalam bentuk deskriptif. Langkah terakhir adalah menarik kesimpulan secara deduktif yakni dari hal-hal yang bersifat umum disimpulkan menjadi hal hal yang bersifat khusus. Hasil penelitian dalam tesis ini adalah bahwa keanggotaan Indonesia dalam TRIPs tidak terlepas dari keanggotaan Indonesia dalam GATT. Indonesia masuk menjadi anggota GATT berdasarkan ketentuan pasal XXVI khususnya pasal XXVI 5(c). Keanggotan Indonesia dalam TRIPs telah diratifikasi melalui Undang-Undang Nomor 7 tahun 1994. Dengan demikian Indonesia secara resmi telah menjadi anggota dalam persetujauan tersebut. Keanggotaan Indonesia dalam lembaga internasional ini akan menimbulkan pengaruh yang tidak dapat diabaikan baik dalam kehidupan ekonomi maupun kehidupan hukum di Indonesia. Perlindungan indikasi geografis belum menemukan bentuk ditingkat internasional. Sehingga negara-negara penandatangan TRIPs memutuskan solusi secara sendiri-sendiri supaya Indikasi Geografis dapat terlindungi di negara masing-masing. Pasal 22 ayat (2) perjanjian TRIPs menegaskan keharusan bagi tiap negara penandatangan untuk mengimplementasikan ketentuan indikasi geografis versi TRIPs di tingkat nasional. Seperti telah disinggung sebelumnya hal yang menarik dari implementasi indikasi geografis versi TRIPs adalah ruang yang dibuka oleh perjanjian ini bagi tiap tiap negara penandatangan untuk memilih versi perlindungan yang paling cocok. Disebutkan didalam pasal 23 ayat (1) TRIPs bahwa setiap anggota harus menyediakan upaya hukum bagi pihak-pihak yang berkepentingan untuk mencegah penggunaan suatu indikasi geografis. Hal inilah yang menyebabkan terjadi ketidakpastian hukum dalam perlindungan terhadap indikasi geografis. Tidak ada penjelasan lebih lanjut tentang upaya hukum tersebut apalagi unsur-unsur yang dilindungi ini. Secara garis besar manfaat perlindungan Indikasi Geografis yaitu fungsi promosi bagi produk Indikasi Geografis yang dilindungi. Indikasi geografis adalah sumber informasi penting untuk konsumen pada pasar yang sangat beragam dalam kaitan dengan asal, kualitas serta reputasi produk yang bersangkutan.

The purpose of this research are to analyze how Indonesian membership in the TRIPs agreement, to analyze the consequences for protecting Geographical Indications in Indonesia after the ratification of the TRIPs agreement, and to analyze the benefits of ratifying the TRIPs agreement for the protection of Geographical Indications in Indonesia. The research method in this thesis is descriptive analytical with a normative juridical approach where legal material and research results are analyzed qualitatively and subsequently presented in descriptive form, where the final step is to draw conclusions deductively that is from general matters concluded in special things. The results of the research are: Indonesia's membership in TRIPs is inseparable from Indonesia's membership in the GATT. Indonesia is a member of the GATT based on the provisions of article XXVI specifically article XXVI 5 (c) and has been ratified through law Number 7 of 1994. Thus, Indonesia has officially become a member of the agreement. Indonesia's membership will have an influence that cannot be ignored both in economic life and legal life in Indonesia. So that countries signing TRIPs to decide solutions individually, geographical indications can be protected in their respective countries. Article 22 paragraph 2 of the TRIPs agreement confirms the necessity for each signatory country to implement the geographical indication provisions of this version of TRIPs at the national level. The interesting thing about implementing the geographical indication of the TRIPs version is the space opened by this agreement for each of the signatory countries to choose the most suitable protection version. It is stated in Article 23 paragraph 1 of TRIPs that each member must provide legal efforts for parties concerned to prevent the use of a geographical indication. This is what causes legal uncertainty in the protection of geographical indications. There is no further explanation of the type or detail of the legal remedies, especially the protected elements. The benefits of the protection of geographical indications are: Promotion function, for products that are geographically protected. Geographic Indications are a source of important information for consumers in markets that are very diverse in relation to the origin, quality and reputation of the product concerned.
