ANALISIS PERLAKUAN PEMENUHAN KEWAJIBAN PAJAK PERTAMBAHAN NILAI (PPN) BAGI USAHA MIKRO, KECIL, DAN MENENGAH (UMKM) DI INDONESIA

Penelitian ini bertujuan untuk memaparkan latar belakang penerapan peraturan dalam rangka pemenuhan kewajiban PPN bagi UMKM serta dampak penerapan peraturan PPN saat ini terhadap kepatuhan dan penerimaan PPN dari pelaku UMKM. Penelitian ini juga bertujuan mengidentifikasi faktor-faktor yang menjadi penyebab belum optimalnya kontribusi PPN dari pelaku UMKM. Penelitian ini menggunakan pendekatan kualitatif melalui strategi studi kasus. Pengumpulan data dilakukan melalui wawancara, observasi dan analisis dokumen. Teknik analisis data menggunakan model interaktif Miles dan Huberman. Hasil penelitian menyimpulkan bahwa penerapan aturan yang ada telah mengakomodasi prinsip fundamental perpajakan The Ottawa Taxation Framework Condition yang mencakup efficiency, fairness, certainty, flexibility dan neutrality. Penerapan peraturan terkait angka batasan omzet pengusaha kecil 4,8 miliar rupiah sebagaimana terdapat pada PMK No. 197/ PMK. 03/2013, belum melalui kajian khusus terkait PPN. Namun demikian, angka tersebut didapat berdasarkan peraturan lain yang beda jenis pajaknya, yaitu PP 46/2013 pada jenis pajak PPh. Dampak dari peraturan tersebut adalah adanya upaya dari pengusaha untuk menghindar dari kewajiban menjadi pemungut PPN sehingga jumlah PKP yang ada khususnya dari pelaku UMKM relatif rendah. Dampak lain ialah rendahnya persentase kontribusi PPN dari pelaku UMKM terhadap penerimaan pajak. Faktor-faktor yang menjadi penyebab belum optimalnya kontribusi PPN antara lain terkait tingginya biaya kepatuhan pajak bagi pelaku UMKM yang menjadi PKP. Selain itu, batasan Pengusaha Kena Pajak di Indonesia saat ini terlalu tinggi jika dibandingkan dengan negara-negara lain di ASEAN bahkan dunia. Hal itu menjadi celah bagi pihak-pihak yang tidak bertanggung jawab untuk memanfaatkan peraturan yang berlaku. Faktor persaingan usaha juga menjadi penyebab mayoritas pelaku UMKM memilih untuk tidak berkontribusi menjadi agen pemerintah untuk memungut PPN, yakni menjadi Pengusaha Kena Pajak.

This research aims at describing the background of value added tax (VAT) fulfilment implementation on micro, small, and medium enterprises and the current impacts of VAT fulfilment on VAT compliance and revenue from MSME. Furthermore, this research also aims at identifying the factors which cause the non-optimal contribution of VAT from MSME practitioners. This research uses a qualitative approach with a case study strategy. The data collection is conducted by means of interviews, observation, and document analysis. The data collected are analyzed using Miles and Huberman�s interactive model. The research results show that the current regulation implementation has accommodated the fundamental principles of taxation, which are agreed by the OECD (The Ottawa Taxation Framework Condition), the principles include efficiency; fairness; certainty; flexibility; and neutrality of tax collection. The regulation implementation regarding the small enterprise�s turnover threshold of 4.8 billion rupiahs, as stipulated in the PMK No. 197/ PMK. 03/ 2013, hasn�t been subjected to a special examination regarding VAT. However, the number is based on another regulation for a different type of tax, namely PP 46/2013, on income tax type. The impact of the regulation implementation has caused businessmen to try and evade the responsibility as VAT collectors, as a result, the number of taxable entrepreneurs for VAT purposes, especially among MSME practitioners, is relatively low. The other impact is that there is a low percentage of the VAT contribution of MSME practitioners in the overall tax revenue. The research results show that the factors which cause the non-optimal VAT contribution include, among others, the high cost of tax compliance for MSME practitioners who become taxable entrepreneurs for VAT purposes. Additionally, the current VAT threshold in Indonesia is not relevant and is too high compared with that applied in other countries in ASEAN, even in the world. This has become a loophole for irresponsible practitioners to take advantage of the existing regulation. The business competition factor is also the reason why the majority of MSME practitioners decide not to contribute as the government�s agents to collect VAT, that is, by becoming taxable entrepreneurs for VAT purposes.
