PELAKSANAAN PERATURAN DAERAH PROVINSI NUSA TENGGARA BARAT NOMOR 3 TAHUN 2014 TENTANG KAWASAN TANPA ROKOK DI PERKANTORAN PEMERINTAH TERKAIT BIDANG KESEHATAN

Penelitian ini bertujuan untuk mengetahui, menganalisis pelaksanaan Peraturan Daerah Provinsi Nusa Tenggara Barat Nomor 3 Tahun 2014 Tentang Kawasan Tanpa Rokok di Tempat Kerja sebagaimana diatur dalam Pasal 4 huruf f dan Pasal 10 huruf a serta kendala dan upaya yang dilakukan oleh perkantoran pemerintah terkait bidang kesehatan. Jenis penelitian ini normatif empiris. Penelitian dilakukan melalui studi lapangan dan didukung penelitian kepustakaan. Lokasi penelitian dilaksanakan di Dinas Kesehatan (Dikes) Provinsi Nusa Tenggara Barat (NTB) dan Rumah Sakit Umum Daerah (RSUD) Provinsi NTB. Narasumber penelitian adalah Sekretaris Daerah Provinsi NTB, Ketua Bappeda Provinsi NTB dan Kepala Biro Hukum Provinsi NTB. Responden adalah Kepala Dikes dan pejabat di lingkup Dikes Provinsi NTB, Direktur dan pejabat di lingkup RSUD Provinsi NTB. Pengumpulan data dilakukan dengan cara kuisioner, wawancara, dan hasil analisis dengan metode penelitian kualitatif dan disajikan secara deskriptif. Hasil penelitian dapat disimpulkan bahwa Pelaksanaan Perda Nomor 3 Tahun 2014 Tentang KTR terkait bidang kesehatan di perkantoran sudah berjalan cukup baik namun belum maksimal. Kendala yang dihadapi, Dikes dan RSUD belum ada petugas khusus penegak KTR, masih ada yang merokok secara sembunyi, mengingatkan orang untuk tidak rokok tidak mudah sudah menjadi interaksi budaya dan mata pencaharian masyarakat setempat, orang yang datang di RSUD setiap saat berganti, areal Dikes dan RSUD sangat luas sehingga tidak bisa selalu mengontrol, peran serta masyarakat masih rendah, pengusaha rokok masih diberi kelonggaran dalam memproduksi rokok. Upaya yang dilakukan, Dikes membuat Gazebo untuk tempat khusus merokok, Kepala Dikes dan Direktur RSUD selalu memberikan pengarahan bagi staf untuk tidak merokok di KTR, RSUD memberi penyuluhan melalui staf promosi kesehatan yang ditujukan kepada pengunjung, seperti pasang pamflet, spanduk, penampilan informasi KTR melalui monitor TV, melakukan kebijakan penganggaran untuk sosialisasi bahaya rokok dan KTR.

This research aimed to identify and analyze the implementation of provincial regulations of West Nusa Tenggara Province number 3 of 2014 regarding non smoking area at government institutions related with health sector which it stated on Article 4 Letter f and Article 10 Letter a, and the constraints and efforts made by the governmental offices related to the health sector. This research was juridical empirical research which it consisted field research and library research. Field research was conducted to collect the primary data and the library research was conducted to collect the secondary data. The primary data collected from research subject and the secondary data collected from literatures study. The data was analyzed by using qualitative. Research location was conducted at provincial Health Office and Public Hospital of West Nusa Tenggara Province. The conclusions of this research were: the implementation of provincial regulations of West Nusa Tenggara Province number 3 of 2014 regarding non smoking area at government institutions related with health sector has been running well but it has not been optimal. The obstacles which it occurred in its implementation such as: There was not the specific officers who were supervising at the non smoking area both in Provincial Health office and Public Hospital of West Nusa Tenggara Province; some of government officers in both institutions were still smoked secretly. It was not easy to remind the other people to stop smoking because smoking cigarettes has become a cultural interaction and the livelihoods of local communities; there were so many people who come in the public hospital area at any time change; the space of the public health office and Hospital are very large and can not be controlled fully; community participation is still low; the tobacco companies are still being given some leeways in producing cigarettes. Efforts are being made, Provincial Health Office makes a special place for officers to smoke, its chairman and the director of public hospital always provide guidance for staffs not to smoke in the smokeless cigarette area, they tell some warnings and guidance to the hospital visitor via pamphlets, banners, infrormation display of non smoking area through TV monitors, perform budgetary policy to socialize about the danger of cigarettes and the non smoking area.
