MEWUJUDKAN GOOD VILLAGE GOVERNANCE (Analisis Isi Prinsip-Prinsip: Transparansi, Responsivitas, Akuntabilitas, dan Partisipasi Masyarakat dalam Undang-Undang Nomor 6 Tahun 2014 Tentang Desa)

Undang-Undang Nomor 6 Tahun 2014 tentang Desa disahkan sebagai perbaikan sekaligus menggantikan ketentuan-ketentuan tentang tata kelola desa yang terdapat pada Pasal 200 sampai dengan Pasal 216 Undang-Undang Nomor 32 Tahun 2004 tentang Pemerintahan Daerah. Salah satu kebijakan utama yang di bawa oleh undang-undang desa yang baru adalah adanya peningkatan alokasi dana yang masuk ke desa yang diperkirakan akan berkisar 700 juta sampai dengan 1,4 miliar rupiah per desa. Kebijakan yang berupa desentralisasi fiskal ke desa tersebut menunjukkan keberpihakan dan prioritas yang lebih besar dari pemerintah terhadap peningkatan pembangunan dan pelayanan masyarakat demi terwujudnya kemakmuran masyarakat desa yang berkeadilan. Namun pemusatan dana ke desa tersebut juga menimbulkan kekhawatiran tersendiri. Desentralisasi tanpa disertai demokratisasi akan menyebabkan timbulnya pemusatan kekuasaan pada elit desa yang selanjutnya dapat melahirkan tindakan penyalahgunaan wewenang dan tindakan-tindakan koruptif yang dapat merugikan kepentingan masyarakat desa. Oleh karena itu menjadi penting dan menarik untuk meneliti sekaligus menjadi tujuan penelitian ini yaitu tentang bagaimana UU No. 6 Tahun 2014 mengatur demokratisasi desa yang tertuang dalam prinsip-prinsip good governance desa. Untuk mencapai tujuan penelitian tersebut, peneliti melakukan kajian terhadap undang-undang desa yang baru ini dengan menggunakan metode analisi isi teks kualitatif. Hasil temuan penelitian menunjukkan bahwa UU No. 6 Tahun 2014 sudah mengatur keempat prinsip good governance melalui ketentuan-ketentuan dalam pasal maupun penjelasannya, meskipun dalam beberapa hal belum seperti kondisi ideal yang diharapkan. Transparansi masih hanya menekankan pada kewajiban pemerintah untuk menyediakan informasi penyelenggaraan pemerintahan desa namun belum menjamin kemudahan masyarakat untuk dapat mengaksesnya. Responsivitas pemerintah desa secara normatif sudah berupaya menggali aspirasi dan permasalahan masyarakat melalui Musrenbangdes, namun ada keharusan perencanaan pembangunan desa untuk mengacu pada perencanaan pembangunan supra desa. Selain itu belum ada pengaturan yang jelas mengenai mekanisme responsivitas anggota BPD yang menyebabkan kesulitan untuk menjamin aspirasi yang dibawa merupakan aspirasi masyarakat desa dan bukan merupakan aspirasi pribadi mereka atau kelompok elit desa. Akuntabilitas pemerintah desa lebih condong ke arah supra desa daripada masyarakat yang merupakan pemilik sebenarnya dari otoritas yang dimiliki aparat pemerintah desa. Akuntabilitas anggota BPD tidak di atur secara jelas, sehingga masyarakat tidak memiliki sarana untuk mengontrol kinerja para wakil mereka. Masyarakat memiliki hak untuk berpartisipasi dalam proses penyelenggaraan pemerintahan desa mulai dari perumusan, pelaksanaan, hingga pengawasan pelaksanaan kebijakan desa, namun terkait dengan tingkat partisipasinya masih dipengaruhi peraturan-peraturan lain yang dapat mendukung/menghambat derajat partisipasinya.

The law no. 6/2014 concerning Village has been legalized to reform as well as to replace the rules of village governance contained in Article no. 200 until Article no.216 of Law No. 32/2004 about Regional Government. One of the main policy that was brought by the new regulation about the village is the increasing amount in the fund allocation to the village ranging from 700 million to 1.4 billion rupiahs for each village. Fiscal decentralization policy to the village shows alignments and greater priority to the improvement of government development and the rural community service in order to achieve equitable prosperity of rural communities. However, the centralization of funds to the village also raises its own concerns. Decentralization without democratization will cause concentration of power in the elite of the village who subsequently can cause the authority abuse and corrupt actions that could harm the interests of the villagers. Therefore, it is important and interesting to study how the Law No 6/2014 regulate democratization of the village viewed through the good village governance principles. To achieve the objectives of the study, researchers conducted a study of the new village regulation by using the qualitative content analysis method. The findings of research indicated that Law No. 6/2014 already regulated the four of good governance principles contained in the articles or explanation of the law, however it has not been as ideal as the expected conditions in some ways. The transparency still only emphasizes the government's obligation to provide information of village governance, but has not been guarantee the public access to the information. The responsiveness of the rural government normatively has attempted to explore aspirations and problems of society through Musrenbangdes, yet there is the rule that village development planning must refer to the development planning on higher level of government. Moreover, there are no clear regulations about the responsiveness mechanism of the BPD (villagers representative board) which causes difficulty in ensuring the aspirations brought by BPD are truly the aspirations of the rural people than just the aspirations of themself or the village elite group. The accountability of rural government are more directed towards higher level of government than rural/village society which actually hold the authority. Accountability of BPD members are not regulated explicitly, so that people do not have means to control their representatives performance. Society has a right to participate in the village governance process from the formulation, implementation and control of village policies execution, however the society participation is still influenced by other regulations that can support/hinder the degree of participation.
