Analisis Hukum Terhadap Perlindungan Kebebasan Berekspresi Untuk Minoritas Gender dan Seksual Menurut International Covenant on Civil and Political Rights di Indonesia

Penelitian ini bertujuan untuk mengkaji kesesuaian perlindungan kebebasan berekspresi pada Pasal 19 ayat (2) International Covenant on Civil and Political Rights (ICCPR) serta pembatasannya dalam Pasal 19 ayat (3) yang telah diinkorporasikan ke dalam beberapa peraturan perundang-undangan di Indonesia terutama berkaitan dengan isu Minoritas Gender dan Seksual atau yang lebih sering disebut dengan Lesbian, Gay, Biseksual dan Transgender (LGBT). Metode penelitian yang digunakan untuk mengkaji isu tersebut bersifat normatif yuridis dengan mempelajari berbagai peraturan perundang-undangan, teori-teori hukum dan bahan hukum sekunder yang berkaitan dengan perlindungan kebebasan berekspresi untuk Minoritas Gender dan Seksual yang dilakukan dengan studi kepustakaan. Data-data tersebut kemudian dianalisis dengan 4 (empat) metode interpretasi, yaitu interpretasi gramatikal, komparatif, teleologis dan sistematis. Hasil penelitian menunjukkan bahwa aplikasi Pasal 19 ayat 3 ICCPR di Indonesia melanggar prinsip prescribed by law dan principle of necessity and proportionality. Pertama, pelanggaran prinsip prescribed by law disebabkan oleh kontradiksi budaya yang di satu sisi mengakui eksistensi Minoritas Gender dan Seksual dan yang di sisi lain menolak. Hal ini menyebabkan adanya kerancuan definisi moralitas yang digunakan untuk membatasi kebebasan berekspresi Minoritas Gender dan Seksual karena kebudayaan merupakan salah satu sumber moralitas. Kedua, pelanggaran principle of necessity and proportionality disebabkan oleh karena mekanisme pembatasan yang digunakan terlalu berlebihan dan tidak ada hubungan yang rasional antara tujuan yang ingin dicapai dengan mekanisme yang digunakan untuk membatasi kebebasan berekspresi Minoritas Gender dan Seksual.

This research aims to review the compliance of protection of freedom of expression on Article 19 paragraph 2 of International Covenant on Civil and and Political Rights (ICCPR) and its limitations on Article 19 paragraph 3 which are already incorporated into several Indonesian laws correlated to Gender and Sexual Minorities issues or more commonly referred to Lesbian, Gay, Bisexual and Transgender (LGBT). The method used to review this issue is legal-normative by studying several laws, legal theories and secondary legal sources relevant to protection of freedom of expression for Gender and Sexual Minorities accomplished by literature studies. These data will then be analyzed through 4 (four) methods of interpretation, namely grammatical, comparative, teleological, and systematic interpretation. The result of the research shows that the application of Article 19 paragraph 3 of ICCPR in Indonesia violates the principle of prescribed by law and principles of necessity and proportionality. Firsly, the violation of principle of prescribed by law is caused by the cultural contradiction, affirming the existence of Gender and Sexual Minorities on one side, and denying their existence on the other. This fact causes perplexity on the definition of morality used to limit the freedom of expression for Gender and Sexual Minorities since culture is one of the sources of morality. Secondly, violation of principles of necessity and proportionality is caused by excessive limitative mechanisms and absence of rational connection between the aims and the mechanisms used to limit the freedom of expression for Gender and Sexual Minorities.
